MEMORANDUMOFAGREEMENT <br />CENTERVILLEMODELINGSUPPORT <br />FOR <br />21STAVENUESOUTHFEMALOMR <br />MEMORANDUMOFAGREEMENTΛͻ!ŭƩĻĻƒĻƓƷͼΜbetweentheRiceCreekWatershedDistrict, <br />4325PheasantRidgeDriveNE,Suite611,Blaine,Minnesota55449andCityofCenterville,1880 <br />MainStreet,Centerville,MN55038. <br />WHEREAS,theRiceCreekWatershedDistrictΛͻ5źƭƷƩźĭƷͼΜhasdevelopedtheDistrictWide <br />ModelingProgramΛͻ5‘atͼΜͲincludingasuiteofhydrologyandhydraulicmodelsofthe <br />watershed,modelproductsandtoolsforoperationaluse.TheDWMP,orpartsthereof,are <br />availabletocitiesandothermembersofthepublicpursuanttoalicensingagreement. <br />WHEREAS,theDistrictengineer,HoustonEngineering,Inc.ΛͻI9Lͼ),maintainsandupdatesthe <br />DWMPandisfamiliarwiththehydraulicandhydrologicconditionswithinthewatershed, <br />includingthemethodsandproceduresusedbytheFederalEmergencyManagementAgency <br />ΛͻC9a!ͼΜinimplementingtheNationalFloodInsuranceProgramΛͻbCLtͼΜwithinthewatershed. <br />WHEREAS,theCityofCentervilleΛͻ/źƷǤͼΜͲasalocalgovernmentunitimplementingtheNFIP,is <br />engagedwithFEMAinC9a!͸ƭfloodinsuranceratemaprevisionprocessfortheClearwaterCreek <br />floodplain.TheCityrequirestechnicalassistancetorespondtoFEMAquestionsand <br />requirementsandbelievesitwouldbecosteffectiveforHEItoprovidesuchassistance,atthe <br />/źƷǤ͸ƭcost. <br />WHEREAS,theDistrictwishestofacilitatethistechnicalassistancebutalsodoesnotwishtohave <br />itsstafforfinancialresourcesdivertedbyprocessorlegalcomplicationsinvolvingFEMA,theCity, <br />orthirdpartiessuchasinterestedpropertyownersoradjacentcities. <br />WHEREAS,inordertopreventaconflictofinterest,the5źƭƷƩźĭƷ͸ƭretaineragreementwithHEI <br />prohibitsHEIfromprovidingprofessionalservicestocitieswithinDistrictboundaries.HEIis <br />concernedtoavoidaconflictofinterestthatwouldbecreatedbyitsprovidingprofessional <br />servicestotheCityasaclientorthatwouldbesubjecttoCitydirectionorcontrol. <br />WHEREAS,onFebruary10,2022FEMAissuedanotificationtotheCitythatanapplicationfora <br />LetterofMapRevisionBasedonFill,datedNovember4,2021,foraprojectadjacenttothe <br />intersectionof21stAvenueSouthandClearwaterCreek,alsoknownasAnokaWashington <br />JudicialDitch3,wasbeingplacedonholdduetothediscoveryofpriorunauthorizedfill <br />placementwithintheregulatoryfloodwayinthislocation. <br />WHERAS,onAugust2,2022theCityrequestedthattheRCWDandHEIprovidetechnicalsupport <br />totheCityinaddressingC9a!͸ƭreferencednotification. <br />1 <br /> <br />
