City of Centerville <br />City Council Meeting Minutes <br />February 8, 2023 <br />Mayor Love stated that an additional candidate, Mr. Anderson, was interviewed during the Work Session <br />and spoke of Council’s desire to provide ample opportunity for those that wanted to apply to apply. <br /> <br />Motion by Council Member Mosher, seconded by Council Member King to Table the Vacant <br />Council Seat Appointment to their next meeting of February 22, 2023. All in favor. Motion <br />carried. <br /> <br />2. Res. #23-0XX – Adopting Special Assessments on 2022 Thin Mill & Overlay Project <br /> <br />Administrator Statz stated one (1) resident appeared before the Council at their last meeting and had <br />concerns that her notification was incorrect. It was felt that at that time, ensuring accuracy was priority <br />and allowing staff additional time to review was appropriate. <br /> <br />to complete additional research to determine whether it was correct that last meeting was assessment <br />hearing and one individuals came forward and thought assessment was for $600 ours was $650 and <br />verified $650 and was tabled last time to ensure accuracy. <br /> <br />Once adopt and when pay and interest one detail lower interest rate discussed previous all <br />documentation left as before you three years 5% language with documents. <br /> <br />Motion by Council Member Koski, seconded by Council Member Mosher to Adopt Res. #23-009 – <br />Special Assessments on 2022 Thin Mill & Overlay Program as presented. All in favor. Motion <br />carried. <br /> <br />IX. NEW BUSINESS <br /> <br />1. Park Dedication Fee Appeal – Curtis Ventures, LLC <br /> <br />Administrator Statz stated that the item was discussed at the work session prior to the meeting. <br />Administrator Statz stated that Mr. Lucas Wiborg, Curtis Ventures, LLC requested a refund of $5,850.75 <br />= $2,175/acre that was paid by Welsch Construction, LLC (contractor-building permit issuance) for Park <br />Dedication fees. He stated that Mr. Wiborg requested the refund shortly following the issuance of the <br />building permit for 2050 Main Street which included improvements to 2070 Main Street and fees had <br />never been paid for that lot but 2050 Main Street previously paid a $750 Park Dedication fee in the 1980s. <br />Administrator Statz stated that he City has the ability to negotiate the fee is Council chose. <br /> <br />Discussion ensued regarding disclosure prior to purchase, the amount to negotiate and being fair and <br />impartial, rights of the city, city code and modifications over time, City Attorney Glaser’s opinion and a <br />fee of $2,000 as a good faith negotiated fee. <br /> <br /> <br />Motion by Council Member Koski, seconded by Council Member Mosher to charge $2,000 for <br />Park Dedication fees rather than what was assessed on building permit ($5,850.75) and provide a <br />refund accordingly.
