Existing Conditions and Property History <br />The property contains an existing home and outbuilding. In 2022, the primary structure <br />(home) was deemed uninhabitable by the city's building official after a stretch of <br />unlawful activity on the premises, culminating in the copper wiring and piping being <br />stripped from the building, for scrap. The result was a home without electricity, heat or <br />supply-side plumbing. The lack of these basic services is generally prima -facia evidence <br />that the home is not fit for human habitation. <br />Since that time, the home has remained vacant and was sold to Duck Hook Properties <br />(DHP), LLC, in March of 2023. <br />Project Narrative <br />The buyer (DHP) has been corresponding with city building officials and the city <br />administrator to determine what can be done with the property. We understand that the <br />buyer has explored the possibility of creating a subdivision with townhomes, but <br />ultimately, could not get the layout to work, given the city's requirement for a public <br />roadway. After exploring a subdivision, the applicant has expressed interest in <br />renovating the home and feels that making it a duplex would be more marketable. Under <br />the current zoning (R2), a duplex is not allowed. Thus, the application for rezoning to <br />R2A, a zoning district which allows such a use. <br />The existing structure, whether as a single home or duplex, and whether in the R2 or R2A <br />zoning district meets all setbacks. Therefore, in either scenario, the building would be a <br />conforming use, once brought up to building code standards. One additional item <br />necessary to bring the property into compliance with the city's zoning ordinances would <br />be to provide a paved driveway. <br />Surrounding Zoning <br />Zoning to the south and north is currently R2. However, a few years ago, the property to <br />the north and west of the subject parcel requested, and was granted, conditionally, a <br />rezoning to R2A. The rezoning was conditioned on the development of a 24-unit <br />detached townhome neighborhood.
