COSTSHAREAGREEMENT <br />RICECREEKWATERSHEDDISTRICTand\[\] <br />CentervilleLakeInternalPhosphorusLoadReduconProject <br />A.TheRiceCreekWatershedDistrict(RCWD)and___________enterintothisagreementtofacilitate <br />RCWDperformanceoftheCentervilleLakeInternalPhosphorusLoadReduconProjectΛͻtƩƚƆĻĭƷͼΜͲ <br />intendingittobelegallybinding. <br />B.TheProjectwillprovidefortheinlakeapplicaonofaluminumsulfateΛͻğƌǒƒͼΜtoCentervilleLake,in <br />ordertoreducesedimentphosphorusreleasewithinthelakeandimprovewaterqualityandclarity.The <br />Projectplanprovidesfortwoapplicaons,in2024and2026.Betweenthetwoapplicaons,RCWDwill <br />collectsedimentcoresandusesedimentchemistrydatatore ŋ netheseconddose.RCWDesmatesthat <br />theacvitywillreducephosphorusloadingtoCentervilleLakeby178poundsannually,andwillallow <br />thelaketotransionfromimpairedtounimpairedstatus. <br />C.RCWDappliedtotheStateofMinnesotaforacompeveCleanWaterFund(CWF)grantforthe <br />Project,andhasbeenawardedagrantintheamountof$954,500.Thegrantrequiresalocalmatchin <br />theamountof10percentofthegrantaward.___________ŋ ndstheProjecttobeinthepublicinterest, <br />andwishestocontributeapartofthelocalmatchinordertoadvancetheProject. <br />D.RCWDhasretainedaquali ŋ edandexperiencedengineering ŋ rmtodeterminedosageandprepare <br />speci ŋ caonsfortheProjectandtomonitortheapplicaon.RCWDispreparedshortlytoissuearequest <br />forquotesandtocontractforapplicaoninSpring2024. <br />ACCORDINGLY: <br />1.RCWDwillmaintaincontractswiththeengineerandapplicator,andwillberesponsibletoimplement <br />theProject,makealljudgmentsintheperformanceoftheProject,andmakeallpaymentsduetothe <br />engineerandapplicator.RCWDwillberesponsibletoconformtotheCWFgrantagreementandwill <br />receiveallpaymentsthereunderforProjectuse. <br />2.WhentheworkundertheğƦƦƌźĭğƷƚƩ͸ƭcontractiscompleted,RCWDwillprovideto____________an <br />accounngof:(a)RCWDpaymentundertheĻƓŭźƓĻĻƩ͸ƭandğƦƦƌźĭğƷƚƩ͸ƭcontracts;(b)theamountof <br />grantfundsreceived;and(c)theamountoftheRCWDpaymenttotheengineerandapplicatornot <br />coveredbygrantfundsΛͻƌƚĭğƌƭŷğƩĻͼΜ͵Within30daysofreceivingtheaccounng,____________will <br />disbursetoRCWDanamountequalto22.6percentofthelocalshareor$35,000,whicheverisless. <br />3.ThisagreementisnotajointpowersagreementwithinthemeaningofMinnesotaStatutes§471.59 <br />andneitherpartyagreestoberesponsiblefortheactsoromissionsoftheotherpartywithinthe <br />meaningofsubdivision1a(a)ofthatstatute.Eachpartyisresponsibleforitsownactsandomissionsto <br />theextentauthorizedbylaw.Thisagreementcreatesnorightinanythirdparty,andwaivesno <br />immunity,defenseorliabilitylimitwithrespecttoanythirdpartyortheotherpartytotheagreement. <br />Onlycontractualremediesareavailableforthefailureofapartytoful ŋ llthetermsoftheagreement. <br /> <br />
