3. What are the zoning laws regarding liquor licensing in proximity to a school?
4. If, for some reason this deal does not go through, is it even possible to consider development of
single family homes on the property?
5. If a developer wanted to put in town homes, what would be the minimum and maximum density
requirements? My best guess is 20-30 townhomes. Am I even in the ballpark?

6. Will a trac study and plan be done before ŋ nal approval is given to the developer? I know they
esmate an extra 600-700 trips / day. Thankfully, they have changed the parking by removing the
paring lot on the south west corner and not opening Westview. However, we are sll concerned with
increased trac and the school parking lot.

7. Most importantly for us, since we are prey sure that luxury apartments are in our best interest
compared to some other ideas, Is there anything the city can do to support us in our desire for a buer
zone? I spoke with the developer and know that this źƭ ĬĻźƓŭ ĭƚƓƭźķĻƩĻķ͵ tĻƩƭƚƓğƌƌǤͲ Lķ ƌźƉĻ Ʒƚ ƭĻĻ
some thing like a hedge-row on the top of the hill that is our property line to the north ( or perhaps a
fence). We are open to other ideas since we are sure the developer has far more experience than we do
with this kind of thing. We would like to have some input and be kept informed of the plans.
That you again and please know that we appreciate the eorts the city has made to keep us
źƓŅƚƩƒĻķ͵ LǝĻ ĬĻĻƓ źƓ ĭƚƓƷğĭƷ ǞźƷŷ .źƌƌƭ ķğǒŭŷƷĻƩͲ /ŷĻƩźĻͲ ŅƩƚƒ me to me; we hope all works out
well for the family.

When you get me can you email me or give me a call at 612.387.8881 to provide me with the
informaƚƓ LǝĻ ƩĻƨǒĻƭƷĻķͪ
Wendy Brilowski
Sent from my iPhone

April 23, 2024
Response from Mark Statz

On Apr 23, 2024, at 1:06PM, Mark Statz <mstatz@centervillemn.com> wrote:
Wendy,
Thanks for reaching out.
1. I'm waing for a response from our aorney. I will let you know as soon as I hear.

2. You are generally correct that there must be a public purpose for the use of eminent
domain. "Economic Development" is not a public purpose when it comes to eminent domain, so you are
correct that we could not take your property and then sell it to a developer. Eminent domain is used for
things like roads, sewers, water mains, trails, and other such public purposes. Being in a TIF district does
not add or subtract from any eminent domain rights the city might have.
3. The city used to have a 500-foot buer around schools for a liquor license. Within the last few years,
the Planning Commission examined this rule and recommended it be eliminated. The City Council
agreed and we no longer have any buer to the school for a liquor license.
4. If the proposed project does not go through, there are a few possibilies:
