May 7, 2024 <br />Centerville Planning & Zoning Commission <br />Page 9 of 12 <br />RE: Ten Nineteen Development LLC, LaLonde Property, PUD Preliminary Development Plan <br />11)No oversized vehicles in the parking lot or taking up more than one space per vehicle. <br />12)Outside Storage – No Outside Storage, as defined by Ordinance, is permitted on the <br />Subject Property other than customary furniture and equipment on the patio or on the <br />individual unit balconies. <br />13)Disturbances Prohibited – The Subject Property, or users thereof, shall not produce noise, <br />vibrations, air pollution, light pollution, fire hazards, or noxious emissions which disturb, <br />endanger, or offend neighboring properties or the public. <br />14)Public Nuisances Prohibited - The Subject Property, or users thereof, shall not create or <br />maintain a public nuisance or disorderly conduct, as defined pursuant to the City’s Code <br />of Ordinances or pursuant to State Law. <br />a.The City deems it to be a public nuisance to smoke, vape, or drink intoxicating <br />beverages within sight of the elementary school property or its students. <br />Accordingly, these activities are not permitted on the east side of the apartment <br />building. <br />b.The City deems it to be a public nuisance to loiter in the vicinity of the elementary <br />school or its students. Accordingly, loitering is not permitted on or from the subject <br />property. <br />c.The City deems it to be a public nuisance for conditions to exist on the subject <br />property which cause the excessive use of law enforcement or emergency <br />services. <br />d.The City deems it to be a public nuisance for conditions to exist on the subject <br />property which allow persons to cross Main Street to or from the west side of the <br />subject property. <br />15)Permits - Landowner will follow the applicable standards and requirements of the City of <br />Centerville City Code, Rice Creek Watershed District, Anoka County, Army Corp of <br />Engineers, Federal Emergency Management Agency, Minnesota Department of Natural <br />Resources, and any other agency having jurisdiction over the Subject Property. Landowner <br />shall grant and allow access by city and other agency personnel to inspect the subject <br />premises for compliance with the aforementioned Permits. <br />16)Legal Compliance – The Subject Property shall be kept in compliance with, and <br />Landowner will obey all laws and regulation necessary to operate this building, and will <br />obtain and maintain, in good standing, all licenses or permits necessary to operate this <br />type of facility. <br /> <br /> <br />
