any owner of the land or shareholder thereof, any person or entity entering upon the <br />Subject Property, or any employee, partner, contractor, heir, or assignee of the <br />Landowner. <br /> <br />FINDINGS OF FACT FOR PLANNED UNIT DEVELOPMENT & CONDITIONAL USE PERMIT <br /> <br />The Planning and Zoning Commission and the City Council made these Findings of Fact <br />in support of the recommendation and approval of this Conditional Use Permit: <br /> <br />1) The applicant will construct a 104-unit apartment project on the subject property <br />consisting of a three-story apartment building. The building will contain parking on <br />its lower level for 110 spaces. Outside of the building, a surface parking lot will <br />accommodate parking for 56 spaces, driveways, and fire lanes. <br /> <br />2) The project is proposed as a Conditional Use Permit for a Planned Unit <br />Development under the standards and processes in the Centerville Zoning Code. <br /> <br />3) The project as conditioned meets the M-2 zoning district standards in <br />Section156.052, the standards for approving a Conditional Use Permit in Section <br />156.210, and the standards for approving a Planned Unit Development in Section <br />156.252(A). <br /> <br />4) The project is in close proximity to Centerville Elementary School. Safety of the <br />students and school-related traffic are critical issues for the school and the <br />community. It is important to create a safe area in the vicinity of the school. <br />Residents and visitors to the project site must travel along the same route as <br />pedestrians, bicycles, bus traffic, and other traffic accessing the school. Traffic <br />around the school is particularly busy at the beginning and end of each school <br />day and during school events. <br /> <br />5) The project will have several hundred residents on site who will reasonably have a <br />desire to walk, bike, or drive in the vicinity. <br /> <br />6) The project will be the first major development in Downtown Centerville and will <br />be expected to Ñreinforce and guide public/private investment in a manner that <br />will strengthen the viability of the area and recommend Downtown Centerville as <br />a community destination of the highest qualityÒ, in the words of the Downtown <br />Centerville Master Plan & Development Guidelines. As such, the project must be <br />clean, orderly, and well managed. <br /> <br />7) Main Street immediately adjacent to the west edge of the project site is a busy, <br />high-traffic roadway with no safe pedestrian crossing to Centerville Lake.
