City of Centerville Planning and <br />Zoning Commission <br />June 4, 2024 <br />15) Construction-related traffic is prohibited from using Westview Street during drop-off and <br />pickup times at Centerville Elementary School, to be coordinated with a written plan <br />developed by the City Administrator, the school administration, and the contractor. <br />16) The parking lot and site plan layout included in the final plans will be subject to the review <br />and approval of the Fire Chief, ensuring adequate space to maneuver public safety <br />vehicles including a ladder truck. <br />17) Disturbances Prohibited Ï The Subject Property, or users thereof, shall not produce noise, <br />vibrations, air pollution, light pollution, fire hazards, or noxious emissions which disturb, <br />endanger, or offend neighboring properties or the public. <br />18) Public Nuisances Prohibited - The Subject Property, or users thereof, shall not create or <br />maintain a public nuisance or disorderly conduct, as defined pursuant to the CityÔs Code <br />of Ordinances or pursuant to State Law. <br /> <br />a. The City deems it to be a public nuisance to smoke, vape, or drink intoxicating <br />beverages within sight of the elementary school property or its students. <br />Accordingly, these activities are not permitted on the east side of the apartment <br />building. <br />b. The City deems it to be a public nuisance to loiter in the vicinity of the elementary <br />school or its students. Accordingly, loitering is not permitted on or from the subject <br />property. <br />c. The City deems it to be a public nuisance for conditions to exist on the subject <br />property which cause the excessive use of law enforcement or emergency <br />services. <br />d. The City deems it to be a public nuisance for conditions to exist on the subject <br />property which allow persons to cross Main Street to or from the west side of the <br />subject property. <br />19) Permits - Landowner will follow the applicable standards and requirements of the City of <br />Centerville City Code, Rice Creek Watershed District, Anoka County, Army Corp of <br />Engineers, Federal Emergency Management Agency, Minnesota Department of Natural <br />Resources, and any other agency having jurisdiction over the Subject Property. <br />Landowner shall grant and allow access by city and other agency personnel to inspect <br />the subject premises for compliance with the aforementioned Permits. <br /> <br />20)Legal Compliance Ï The Subject Property shall be kept in compliance with, and <br />Landowner will obey all laws and regulation necessary to operate this building, and will <br />obtain and maintain, in good standing, all licenses or permits necessary to operate this <br />type of facility. <br />21) Apartment leases shall be no less than twelve months to provide more long-term residents <br />and fewer transients. All leases will be with the apartment management company; no sub- <br />leases will be permitted. <br />21) Balconies shall be constructed of wrought iron vs. aluminum or other material, in keeping <br />the Downtown Master Plan preference for that material. <br />22) Due to concerns about overcrowding, occupancy in the apartment units will be limited to <br />three two times the number of bedrooms in each unit. <br />23) Proof of parking shall be shown on a site plan to be reviewed and approved by the City <br />Engineer and Planning Commission that would provide the required number of parking <br />Page 14 of 16 <br /> <br />
