City of Centerville <br />Planning and Zoning Commission <br />November 12, 2024 <br /> <br />Attorney Baumgartner also noted that a percentage of the revenue on cannabis sales will come <br />back to cities. <br /> <br />Attorney Baumgartner noted that the ordinance being introduced to the Commission does not <br />regulate low potency edibles (hemp-derived), which is already legal. Attorney Baumgartner <br />added that some cities have one ordinance that regulates low potency edibles and cannabis in <br />a combined ordinance. The City of Centerville is introducing just the one ordinance on <br />regulating the sale of cannabis. <br /> <br />Commission Discussion Ensued about the Following: <br /> The city only having a cannabis retail business on a finished product, thereby limiting <br />cultivation to distribution. *Attorney Baumgartner advised that the intent of the <br />proposed ordinance is to start with cannabis retail sales. <br /> The number of registration(s) in the city and limitation to one retailer in the city. *Attorney <br />Baumgartner noted that cities can always have more than one cannabis retail sales <br />business, but that they are required to have at least one of these businesses for every <br />12,500 people. Administrator Statz added that if the County gets one of these businesses <br />before the city does then the city could deny registrations; he noted that it is unlikely <br />that the city will not receive an application first. <br /> Compliance checks and enforcement. *Attorney Baumgartner noted that there are not <br />good ways to test limits like there are for alcohol. <br /> Hours of operation exclude Sunday. *Attorney Baumgartner noted that there was not a <br />specific reason for excluding Sunday hours in the draft ordinance. <br /> Preliminary approval at the State for social equity applicants, as outlined in State Statute <br />342.17. *Attorney Baumgarter noted that once social equity applicants receive priority <br />over regular applicants, and once approval is granted at the state, applicants can then <br />go through the city registration process. He also added that there are several licenses <br />available for social equity applicants and a certain number for regular applicants, and <br />if the number of applicants in each of these groups exceeds the number of licensed then <br />the state will use a lottery system. <br /> Local control to revoke, suspend licenses. *Attorney Baumgarter noted that cities do have <br />this authority, however the State has the ultimate say in terms of review and can reverse <br />decisions made locally. <br /> Inquiry about the Colorado study in terms of if there is data on additional arrests, etc. <br />*Attorney Baumgartner said that the scope of the study did not cover arrests, although <br />he thinks arrests have increased some. <br /> Zoning designation. Administrator Statz noted that his intent is not to add anything to the <br />Table of Allowed Uses, Table 156-A because Cannabis sales is a retail business, and <br />businesses are allowed in the business district. Commissioner Seppala asked if this <br />would be allowed in the M-1 and M-2 districts and Administrator Statz said that it is, <br />but that we could do a text amendment restricting cannabis sales from the M-1 and M- <br />2 districts. There is also a clarification about the ordinance having language that states <br />that cannabis retail businesses shall be 1,000 feet from a school (the draft ordinance <br />states 500 feet). <br /> Clarification on if a cannabis retail sales business is a stand-alone business. *Attorney <br />Baumgartner noted that it is. <br /> <br />Page 2 of 7 <br /> <br />
