City of Centerville <br />Planning and Zoning Commission <br />November 12, 2024 <br /> <br />licensed day cares in the language. Attorney Baumgartner noted that the state statute speaks mostly <br />to non-residential licensed day cares. The Department of Human Services (DHS) has a list of <br />licensed day cares, and the Commission would like there to be a 500-foot radius from licensed day <br />cares regardless of if they are brick and mortar or home-based. Staff will look up the licensed <br />businesses and draw a map showing the 500-foot distance from a licensed day care, and this <br />th <br />information will be provided to city council at their December 5 meeting when the draft ordinance <br />st <br />goes to council for 1 reading. Discussion also ensued about the local registration process. Attorney <br />Baumgartner advised the city to approve the first application that meets all the state and local <br />requirements, because it is easier and does not raise concerns from a discrimination standpoint. <br />Attorney Baumgartner said that he could add language about handling applications if two come in <br />at the same time. Discussion ensued about compliance checks: age verification and merchandise <br />(inventory and licensing). <br /> <br />Motion by Commissioner Seppala seconded by Chair Krueger to adopt the ordinance <br />regulating the sale of cannabis, limiting retail cannabis businesses 1000 feet from a school, <br />and limiting them to the business district known as B-1 and B-2 and adding a definition for a <br />day cay to include in-home licensed daycares, and to adopt cannabis retail businesses for a <br />conditional use. All in favor. Motion carried. <br /> <br />2. LaLonde Property 1687 Westview Street <br />a. Comprehensive Land Use Amendment <br />b. Rezoning <br />Administrator Statz introduced this item as presented in the packet, adding that there was support <br />from the public on the rezoning and comprehensive land use amendment. <br /> <br />Motion by Commissioner Nelson seconded by Commissioner Seppala to recommend <br />approval of the Comprehensive Plan Amendment and Rezoning Applications from <br />Centennial School District 12 for 1687 Westview Street, with findings as presented and <br />including a request that the school and the city engage in a discussion about adding a <br />community center space to the project. All in favor. Motion carried. <br /> <br />3. Call for a Public Hearing Î Table of Allowed Uses <br />Administrator Statz introduced this item as presented in the packet, noting the need to expand the <br />table to allow businesses that are not on the table. <br /> <br />Motion by Commissioner Thompson seconded by Commissioner Olson to call for a <br />Public Hearing to amend the Table of Allowed Uses to Include Businesses that Involve Light <br />Assembly and Light Manufacturing and others. All in favor. Motion carried. <br /> <br />4. Accept Resignation of Matthew McCabe and Declare a Vacancy on the Commission <br />Administrator Statz introduced this item as presented. Chair Krueger thanked Matt for his time. <br /> <br />Motion by Chair Krueger, seconded by Commissioner Seppala to recommend acceptance <br />of Matthew McCabeÓs resignation and the declaration of an opening on the Planning and <br />Zoning Commission.
