April 1, 2025 <br />Centerville Planning & Zoning Commission <br />Page 3 of 7 <br />RE: 1421 Mound Trail, Variance Request Ï Garage & Swimming Pool <br />The Code says that Ñ no accessory <br />structure shall be erected or <br />located within any required yard <br />other than the rear yardÒ.I <br />interpret this to mean that the <br />required yard is the setback, so an <br />accessory structure could be <br />located in the rear yard setback, <br />i.e., it could be further back on the <br />lot where other structures would <br />not be allowed. But an accessory <br />structure is not allowed in any <br />other Ñrequired yardÒ, i.e., within <br />the front,side, or shoreland <br />setback areas. <br />On the lot at 1421 Mound Trail, the <br />Ñrequired yardsÒ are 20 ft and 35 ft <br />to thefront for accessory uses and <br />principal structures, respectively; 5 <br />ft and 10 ft to theside; and 10 ft <br />and 75 ft to the ordinary high <br />water line at thelakeshore, <br />illustrated to theright. <br />Does the size requirement impact <br />where the swimming pool is <br />allowed? <br />The Code notes that Ñswimming <br />pools . . . shall not exceed 50% of <br />the rear yard.Ò This limits the size of <br />a swimming pool it does not <br />explicitly state that a pool must be <br />in the rear yard, only that it can <br />be,and the size is limited. <br />This interpretation is different than City <br />practice over many years. The map on <br />thefollowing page shows several garages in thefront of the lot which were either legal non- <br />conforming structures allowed to build in their existing location or approved by variance. <br /> <br />
