June 24, 2025 <br />Centerville Planning & Zoning Commission <br />Page 3 of 8 <br />RE: Zoning Code Issues & Definitions <br />YARD, REAR. The portion of the yard on the same lot with the principal building located between the rear <br />line edge or building line of the building, and the rear lot line and extending for the full width of the lot. <br /> <br />BUILDABLE AREA. The space remaining on a zoning lot after minimum yard setback and open space <br />requirements have been met, unless as otherwise specified. <br />ACCESSORY BUILDINGS <br />The commissioners also discussed in June how the current code says that Ñ no accessory structure <br />shall be erected or located within any required yard other than the rear yard.Ò This phrase is <br />ambiguous because it uses both Ñrequired yardÒ and plain Ñyard.Ò This phrase could be <br />interpreted in two ways, illustrated below: <br /> <br />1. An accessory structure may be located anywhere on the property except in a required <br />setback, except it can be in the required rear yard/setback. This implies that it could be <br />located in the generic front or side yard. <br /> <br />2. No accessory structure shall be located anywhere on the property other than the rear yard <br />(area behind the house). <br />Figure 1: Current code interpretations. <br />The precedent in Centerville interpretating this code standard is that detached accessory <br />buildings can only be in the rear yard. Many communities allow detached accessory structures to <br />the side of the principal structure, if they are not in front of the house. A third option discussed in <br />June is having different options for sheds than garages; one option would be to allow a shed only <br /> <br />
