June 24, 2025 <br />Centerville Planning & Zoning Commission <br />Page 7 of 8 <br />RE: Zoning Code Issues & Definitions <br />a lakeshore lot, a detached garage or accessory building shall be permitted closer to the <br />front lot line than the front building line or edge of the principal building, provided that <br />the minimum front setback for principal buildings is met, there is screening between <br />the structure and the right-of-way, and that all other required setbacks are met. <br />FENCES & FRONT YARD <br />Based on discussion at the June meeting, the intent is for fencing located between the front lot <br />line and the house be limited to 36 inches in height, while fencing behind the front of the house <br />can be up to six (6) feet in height. Staff recommends the following amendments below in blue <br />and strikethrough to further clarify this for readers. <br />§ 156.111 FENCES AND SPECIAL PRIVACY SCREENING. <br /> <br />(A) General regulations. <br /> <br />(1) All fences shall be located a minimum of two feet from any property line of the fence owner <br />unless the owner of the adjoining property agrees, in writing, that the fence may be erected on <br />the property line of the respective properties. This agreement shall be submitted at the time of <br />building permit application. <br /> <br />(a) Fences shall be located a minimum of two feet from a property line adjoining a street right <br />of way and may not be located in any drainage or utility easement, except where permission <br />has been granted by the City through an encroachment agreement. <br />(b) No fence other than a decorative fence may be constructed within a front yard setback. As <br />used herein, the term DECORATIVE FENCE means a wrought iron fence, wood or vinyl <br />vertical post and wood horizontal rail fence with no more than three rails or a wood or vinyl <br />picket type fence with at least two inches of open space between each picket. All decorative <br />fences shall have at least 40% of the surface area of the fence open. <br /> <br />(2) No residential fence may exceed six feet in height and. No decorative fence within the front <br />yard setback may exceed 36 inches in height. <br />SWIMMING POOLS <br />Swimming pools are considered accessory uses. As discussed in June, a definition for swimming <br />pool should be added. <br /> <br />SWIMMING POOLS. Any pool, tank, or other structure which shall cause or has the capacity to retain water <br />with a depth greater than 30 inches, and is designed to be used for swimming, wading, or immersion purposes <br />by individuals. <br /> <br /> <br />
