June 24, 2025 <br />Centerville Planning & Zoning Commission <br />Page 8 of 8 <br />RE: Zoning Code Issues & Definitions <br />In Section 156.107(A)(10) the code stipulates: <br />(10) Swimming pools may exceed the size requirements for accessory structures, but shall not <br />exceed 50% of the rear yard. <br />This limits the size of swimming pools, but does not explicitly state a swimming pool can only be in <br />the rear yard, which is the precedent in Centerville and staffÔs understanding of the intent of the <br />code. If the commissioners wish to confirm this is the preferred interpretation, staff proposes the <br />following revisions: <br />(10) Swimming pools may only be located in the rear yard of any lot, and may exceed the size <br />requirements for accessory structures, but shall not exceed 50% of the area of the rear yard. <br />CONCLUSION & RECOMMENDATION <br />If there is consensus among the Planning and Zoning Commission on the various issues presented <br />here, the Planning and Zoning Commission can recommend the proposed amendments to the <br />City Council for approval or denial. <br /> <br />
