This is met. <br />(3) No accessory structure may be constructed on a parcel without a principal structure. <br />a. This is met. <br />(4) No accessory structure shall be erected or located within any required yard other than <br />the rear yard. <br />a. The city has interpreted this to mean a detached accessory structure must be <br />within the rear yard. While it may be expensive, the applicant could meet this <br />requirement by moving both the gas meter and well to different locations, and <br />shifting the garage further back on the lot. Another option would be to place <br />the proposed garage elsewhere on the lot, such as to the north/northwest of <br />the house. <br />b. The applicant cites other properties in the city that have garages closer to the <br />road than the house. This includes 1740 Heritage, 7046 Centerville, and 7060 <br />Goiffon. <br />i. Progress Road was originally platted to extend further south; 1740 <br />Heritage appears to have been platted to front this road before it was <br />vacated. Staff cannot verify at the time of writing this report the <br />applicable requirements for accessory structures when this structure in <br />question was built; if this structure were built prior to todayÔs <br />requirements it would be legally nonconforming. <br />ii. 7046 Centerville is a corner lot, and therefore can have an accessory <br />structure 20 feet from the street property line per 156.107(A)(5). <br />iii. 7060 Goiffon has a detached accessory structure that is not in the rear <br />yard, but it is not closer to the road than the house. Staff cannot verify <br />the setback between the garage and house is less than six feet. <br />(5) Detached accessory buildings must have a minimum of a 5-foot interior side setback <br />and a 10-foot rear setback. Where a rear or side yard abuts a street, an accessory <br />building shall be set back a minimum of 20 feet from the street property line. No <br />structure may be placed in an easement except bridges by written permit approved <br />by the City Council. <br />a. This requirement is met. <br />(6) In case an accessory structure is attached to the main building, it shall be made <br />structurally a part of the main building and shall comply in all respects with the <br />requirements of this chapter applicable to the main building. <br />a. N/A <br />(7) An accessory building, unless attached to and made a part of the main building, shall <br />not be closer than 6 feet to the main building, except as otherwise provided in this <br />section. <br />a. The applicant is proposing 1.70833 feet between the house and detached <br />garage. The applicant could meet this requirement by moving both the gas <br />meter and well to different locations, and shifting the garage further back on <br /> <br />
