June 23, 2025 <br />Centerville Planning & Zoning Commission <br />Page 6 of 7 <br />RE: 7064 Centerville Road, Variances for New Detached Garage <br />(6) Any person filing a petition requesting a variance or an amendment of the zoning <br />chapter rezoning property or changing regulations within any use district shall pay a <br />fee according to the schedule established by resolution or ordinance of the City <br />Council. The fee is payable at the time of filing a petition and is not refundable. <br />a. This has been met. <br />OPTIONS <br />The Planning and Zoning Commission has the following options with this request. <br />(1) Recommend the City Council approve the request, with findings and with/without <br />conditions of approval. <br />(2) Recommend the City Council deny the request, with findings for denial. <br />(3) Table the request for further review/study. <br /> <br />RECOMMENDATION <br />Denial <br />If the Planning and Zoning Commission recommends the City Council deny the request, staff <br />would recommend the following findings: <br />(1) The variance is not in harmony with the purposes and intent of the zoning chapter of <br />this code. The current requirements are to have detached structures in the rear yard, <br />and a minimum distance from the primary residence. There are other areas of the <br />property that could be utilized for the proposed detached accessory structure that <br />would comply with city code. In addition, the applicant could remove the existing <br />shed on the site, further bringing the property into code compliance and removing the <br />need to vary from the limit on aggregate accessory structure space. <br />(2) There are not unique circumstances to the property not created by the landowner. <br />While the houseÔs location deep in the lot and the gas meter existed prior to the <br />current owner, the applicant is proposing the proposed location of the detached <br />garage. There are other areas of the property that could be utilized for the proposed <br />detached accessory structure that would comply with city code. <br /> <br />Approval <br />If the Planning and Zoning Commission recommends the City Council approves the request, staff <br />would recommend the following findings: <br />(1) The intent of the code is for a detached garage to be a set distance from the house, <br />to have such structures behind the house, and to limit the amount of accessory space <br />on a lot. The applicant can meet building code requirements to ensure the proximity of <br />the proposed detached garage to the house is not an issue. The proposed garage <br />would be set back further from Centerville Road than neighboring structures, and <br />would not Óstand out.Ô The existing shed predates the applicant. <br />(2) A detached garage is not in conflict with the cityÔs 2040 Comprehensive Plan. <br /> <br />
