(10) Swimming pools may only be located in the rear yard of any lot, and may exceed the size <br /> requirements for accessory structures,but shall not exceed 50%of the area of the rear yard. <br /> (B)(4)No accessory structure shall be erected or located within the front setback. <br /> Section 4. Revisions to§ 156.111(A)(1)(b),(A)(2),and(F)FENCES AND SPECIAL <br /> PRIVACY SCREENING. <br /> (A)(1)(b)No fence other than a decorative fence may be constructed between the edge or building line of <br /> the principal structure and a lot line abutting a street.As used herein,the term DECORATIVE FENCE <br /> means a wrought iron fence,wood or vinyl vertical post and wood horizontal rail fence with no more than <br /> three rails or a wood or vinyl picket type fence with at least two inches of open space between each picket. <br /> All decorative fences shall have at least 40%of the surface area of the fence open. <br /> (2)No residential fence may exceed six feet in height. No decorative fence between the edge or building <br /> line of the principal structure and a lot line abutting a street may exceed 36 inches in height. <br /> (a)Where a corner lot abuts an adjacent property's front setback,the fence shall be set back a <br /> minimum of 10 feet from the adjoining property line,unless the fence is a decorative fence not <br /> exceeding three feet in height. <br /> (b)Residential corner lots shall only have one front setback for the purpose of fences and that <br /> shall be the side that has the front entrance to the home. <br /> (F)Fencing in commercial/industrial zoning districts shall not exceed eight feet in height.Fences,except <br /> decorative fences not exceeding three feet in height,shall not be placed in a front setback of an industrial or <br /> commercial lot. <br /> Section 5. Revisions to§ 156.121(B)HEIGHT. <br /> (B)Excess height on a building. Upon the securing of a conditional use permit,any building may <br /> be erected to a height exceeding that specified for the respective district,provided the front,rear, <br /> side setbacks shall be increased one foot for each one foot by which the building exceeds the <br /> height limit established for that district. <br /> Section 6. Revisions to§ 156.122(A)(1-4)and(B)(1-3)YARDS. <br /> (A)General requirements. The minimum depths of front,rear,and side setbacks for each district <br /> shall be as defined in the schedule of regulations and conform to the following additional <br /> regulations unless otherwise permitted: <br /> (1)All structures,whether attached to the principal structure or not, and whether open or <br /> enclosed,including porches, carports,balconies or platforms above normal grade level <br /> shall not project into any minimum front, side or rear setback. <br /> (2)Lots which abut on more than one street shall provide the required front yards <br /> setbacks from the lot lines abutting each street for the principal structure and for any <br /> accessory building,unless otherwise permitted.Lots which do not abut any streets,or do <br /> not abut the street from which the lot's legal address is derived shall have their lot lines <br /> designated by the Zoning Administrator. <br /> (3)Any principal structure situated on a lakeshore lot in the city shall maintain setbacks <br /> of 75 feet from the lake.Where adjacent structures have setbacks different from these <br /> requirements,the minimum setback from the lake shall be the average setback of the <br /> adjacent structures or a minimum of 50 feet,whichever is greater; and See also <br /> Floodplain Chapter and additional requirements for shorelands. <br /> (4)The minimum side or rear setback depths for the following nonresidential structures <br /> or uses which abut any lot in any residential district shall be: <br />
