City of Centerville <br />Work Session & City Council Meeting Minutes <br />November 13, 2025 <br />Council Member Kubat asked Finance Director DeJong the average length of assessments and he stated <br />3-15 years. Council Member Kubat also asked about the City's current interest rate and Finance Director <br />DeJong replied 3.6%-3.7% for investments. Council Member Kubat stated that for 5 years at 3.5% it <br />would not cost the city any money correct, Finance Director DeJong concurred. Council Member Rios <br />stated that language for five years of assessment was included in the Storm Drainage Grant Program. <br />Council Member Broussard Vickers had several questions/comments including that she felt the city was <br />setting a precedence as this is a private pond. There was some concern regarding the city's continued <br />liability associated with the pond. City Attorney Glaser stated that the city does have responsibility for <br />where the water goes per the city's MS4 Permit but the pond does not become the City's. Council Member <br />Koski asked if this happened in another local and someone stated you did it at this location — do we have <br />to complete for them also. City Attorney Glaser stated there is no legal responsibility that sets the <br />precedence, but Council would need to justify to constituents that it was done before and why, but there <br />was no legal process. Mayor Golden stated that she believed the city was obligated to the runoff due to <br />the MS4. City Attorney Glaser stated that something will need to be obtained by the property owners for <br />temporary construction or permanent easement. He stated that it does not change anything for our current <br />situation. City Attorney Glaser stated that the easement of 5' on each side of the property line would not <br />be enough to have larger equipment in there to accomplish the installation of the pipe, to house the pipe <br />yes but more is needed for the construction, hence the necessity of a Temporary Construction Easement. <br />Council Member Rios stated she felt that council should address the deviation from policy and why the <br />project was brought to Council's attention. City Attorney Glaser stated that the previous City <br />Administrator posed the percentages which deviated from the policy. Council Member Kubat quoted <br />previous City Administrator's information contained in a memorandum dated August 23, 2024 — "During <br />the design and construction of the development, the city experienced turnover at the City Administrator <br />position, City Engineering consultant and the bankruptcy of the developer". "All of these factors lead to <br />a less -than desirable design of the pond and its drainage system". Council Member Kubat felt that there <br />were things that could have been completed differently with the development. City Attorney Glaser stated <br />that when you purchase a home — back walkout and know that there is a wet backyard you do take on <br />some burden, and your neighbors are partially responsible for the water — "I often caution the city in <br />becoming involved with civil issues". He stated that part of the issue is with the developer who is bankrupt <br />and all of the factors that previously stated and it was a substantive call and recommended to council at <br />the time and now this council has to determine what it means to them spending taxpayer money on the <br />project. Council Member Kubat stated that the only reason he is considering this project is that it <br />previously went to council and they approved it and it fell apart for factors that were unanticipated. He <br />stated that he would not consider the project the same way today. Mayor Golden concurred but felt that <br />council needed to honor what was previously done. <br />Lengthy discussion took place regarding assessments for the project and additional costs for a feasibility <br />study, etc. <br />Motion by Council Member Rios, seconded by Council Member Koski to commit up to $39,600 to <br />assist in the resolution of the drainage issue at 6996 Brian Drive dependent on matching funds of <br />$14,400 by the residents with signed Assessment Waivers. Roll call: Mayor Golden, Council <br />Members Koski, Kubat and Rios. Council Member Broussard Vickers Opposed. Motion carried. <br />Mr. James Richards, 1932 Eagle Trail, questioned the responsibility of removal of a tree on his property <br />that in near the pond and within the easement.
