st <br />Name:7075 21!ǝĻ {ΑtğƩƉźƓŭ / <br />t <br />Date:April 7, 2026 <br />Page:4 <br />Findings for Approval <br />CUP Standards. <br />City Code Sec. 156.320(B) outlines the standards and conditions for conditional uses as follows: <br />(1)A Conditional Use Permit may be granted for the following uses only: <br />a.Any use specifically listed as a Conditional Use in the regulations applicable to the district <br />in which it is to be located or otherwise stated in this Chapter to be a conditional use; <br />b.Any use which is the same or similar, and consistent with, a conditional use specified in <br />the use district, the Planning Commission may consider and allow such conditional use. <br />(2)A Conditional Use Permit shall be granted only if evidence is presented to establish: <br />a.That the proposed building or use at the particular location requested is necessary or <br />desirable to provide a service or a facility which is in the interest of the public <br />convenience and will contribute to the general welfare of the neighborhood or city; <br />b.That the proposed building or use will not have a substantial or undue adverse effect <br />upon adjacent property, the character of the neighborhood, traffic conditions, utility <br />facilities and other matters affecting the public health, safety and general welfare; and <br />c.That the proposed building or use will be designed, arranged and operated so as to <br />permit the development and use of neighboring property in accordance with the <br />applicable district regulations. <br />CUP Amendment Findings <br />Staff recommend the following findings supporting approval of theCUP: <br />1.That the applicant has submitted requests to the City of Centerville for a Conditional Use Permit <br />(CUP) in accordance with the procedures as ĻƭƷğĬƌźƭŷĻķ ĬǤ /ĻƓƷĻƩǝźƌƌĻƭ /źƷǤ /ƚķĻͳ ğƓķ <br />2.A Conditional Use Permit is required under City Code Section 156.166 (E) for property owners to <br />receiveflexibility to thenumber of required parking stalls in City Code; and <br />3.That the request for flexibilityis consistent with the overall goals and objectives of the <br />Centerville Comprehensive Plan; and <br />4.That the proposed flexibility isnecessary to reasonably establish a new commercial retail use on <br />the property, and the use is expected to contribute to the generalwelfare of the City; and <br />5.That the request would allow for flexibility to parking standards which will not have a substantial <br />or undue adverse effect on adjacent property, the characterof the surrounding neighborhood <br />and the general health, safety, and welfare of the City; and <br />6.That the proposed flexibility, with conditions as imposed bythe City,will allow for establishment <br />of a retail use which is arranged and operated in accordancewith applicable regulations. <br />CUP Conditions <br />Staff recommend the following conditions of approval for theCUP: <br />1.This Conditional UsePermit is intended to allow flexibility to the standards for retailuses only. <br />Should another use requiring flexibility to the parking code be proposed, an amendment to the <br />CUP is required. <br />2.TheRetail use may include a maximumof 30% of the floor area for walk in customer sales.If a <br />higher amount of floor area is desired for walk in sales, an amendment to the CUP is required. <br />13 <br /> <br />
