st <br />Name:7075 21!ǝĻ {ΑtğƩƉźƓŭ / <br />t <br />Date:April 16, 2026 <br />Page:5 <br />CUP Findings <br />Staff recommend the following findings supporting approval of theCUP: <br />1.That the applicant has submitted requests to the City of Centerville for a Conditional Use Permit <br />(CUP) in accordance with the procedures as ĻƭƷğĬƌźƭŷĻķ ĬǤ /ĻƓƷĻƩǝźƌƌĻƭ /źƷǤ /ƚķĻͳ ğƓķ <br />2.A Conditional Use Permit is required under City Code Section 156.166 (E) for property owners to <br />receive flexibility to the number of required parking stalls in City Code; and <br />3.That the request for flexibility is consistent with the overall goals and objectives of the <br />Centerville Comprehensive Plan; and <br />4.That the proposed flexibility is necessary to reasonably establish a new commercial retail use on <br />the property, and the use is expected to contribute to the general welfare of the City; and <br />5.That the request would allow for flexibility to parking standards which will not have a substantial <br />or undue adverse effect on adjacent property, the character of the surrounding neighborhood <br />and the general health, safety, and welfare of the City; and <br />6.That the proposed flexibility, with conditions as imposed by the City, will allow for establishment <br />of a retail use which is arranged and operated in accordance with applicable regulations. <br />CUP Conditions <br />Staff recommend the following conditions of approval for theCUP: <br />1.This Conditional Use Permit is intended to allow flexibility to the standards for retailuses only. <br />Should another use requiring flexibility to the parking standardsbe proposed, an amendment to <br />the CUP is required. <br />2.The Retail use may include a maximum of 30% of the floor area for walk in customer sales. If a <br />higher amount of floor area is desired for walk in sales, an amendment to the CUP is required. <br />3.Parking area improvements shall not be located within any drainage and utility easement areas <br />unless otherwise approved by the City. <br />4.Use of the parking area is limited to the daily parking of operable,licensed,vehicles unless <br />otherwise approved by the City. <br />5.Prior to establishing the retail use, the Property Owner must bring the parking lot into <br />conformance with City standards for poured in place curbing and bituminous surface. <br />6.The Applicant must obtain and maintain all applicable permits and licenses to improve the <br />property and operate the commercial use on the subject property. <br />Options <br />The City has the following general options regarding the Conditional Use Permit and Site Plan Review <br />Requests: <br />1.Approval <br />2.Approval with conditions(recommended) <br />3.Denial <br />4.Table (City may need to extend the review period to a full 120 days) <br />65 <br /> <br />
