The hearing was notiĭĻķ źƓ ƷŷĻ /źƷǤ͸ƭ ƚŅŅźĭźal newspaper and mailed <br />notices were provided to surrounding property owners. No public comments have any been filed as of <br />the writing of this report nor were any provided at the hearing. <br />Planning and Zoning Commission Recommendation <br />ŷĻ /źƷǤ͸ƭ tεœ /ƚƒƒźƭƭźƚƓ ķźƭĭǒƭƭĻķ ƷŷĻ ƦƩƚƦƚƭĻķ project and heard from the property owner and <br />prospective tenant. The Commission asked questions of the future tenant regarding their retail use. The <br />tenant is a reseller of recycled automotive parts. Retailoperations are primarily online sales with <br />minimal walk in traffic expected. <br />Commissioners asked about stormwater management needs on site, staff are following up on this <br />question and expect to have more information for thĻ /źƷǤ /ƚǒƓĭźƌ͸ƭ ƒĻĻƷźƓŭ͵ !Ʒ Ʒŷźƭ ƷźƒĻͲ ƩĻƨǒźƩĻķ <br />stormwater plans or reviews would be covered by a condition ofapproval before any work can begin on <br />site. <br />The Planning Commission unanimously moved to recommend that the City Council approve this request <br />for flexibility. <br />LƓ ĭƚƓƭźķĻƩğƷźƚƓ ƚŅ ƷŷĻ tƌğƓƓźƓŭ /ƚƒƒźƭƭźƚƓ͸ƭ ķźscussion, staff have since added two recommended <br />conditions for approval that will better reflect expectations for the parking area. Condition 3 will require <br />improvements to stay out of easement areas and condition 4 will require that only operational vehicles <br />are parked in the parking lot. <br />Findings for Approval <br />CUP Standards. <br />City Code Sec. 156.320(B) outlines the standards and conditions for conditional uses as follows: <br />(1)A Conditional Use Permit may be granted for the following uses only: <br />a.Any use specifically listed as a ConditionalUse in the regulations applicable to the district <br />in which it is to be located or otherwise stated in this Chapter to be a conditional use; <br />b.Any use which is the same or similar, and consistent with, a conditional use specified in <br />the use district, the Planning Commission may consider and allow such conditional use. <br />(2)A Conditional Use Permit shall be granted only if evidence is presented to establish: <br />a.That the proposed building or use at the particular location requested is necessary or <br />desirable to provide a service or a facility which is in the interest of the public <br />convenience and will contribute to the general welfare of the neighborhood or city; <br />b.That the proposed building or use will not have a substantial or undue adverse effect <br />upon adjacent property, the character of the neighborhood, traffic conditions, utility <br />facilities and other matters affecting the public health, safety and general welfare; and <br />c.That the proposed building or use will be designed, arranged and operated so as to <br />permit the development and use of neighboring property in accordance with the <br />applicable district regulations. <br />64 <br /> <br />
