RESOLUTION #26-___ <br />CITY OF CENTERVILLE <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO PERMIT PARKING <br />FLEXIBILITY ON LOT 8, BLOCK 1 OF THE INDUSTRIAL PARK PLAT <br />WHEREAS: the City of Centerville is a municipal corporation organized and existing under the laws of <br />the State of Minnesota; and <br />WHEREAS: on March 16, 2026, Lukas Peters (the ÐApplicantÑ) filed a complete request for <br />Conditional Use Permit to allow for parking flexibility on the property with the PID 24-31-22-23-0012 <br />legally described in Exhibit A attached hereto (the ÐPropertyÑ); and <br />WHEREAS: approval of a Conditional Use Permit is required for the proposed land use to conform with <br />the CityÓs adopted plans and policies; and <br />WHEREAS: the public hearing notice was published, mailed, and posted pursuant to the Centerville <br />Zoning Ordinance, and Minnesota Statutes Section 462.355; and <br />WHEREAS: the Centerville Planning and Zoning Commission held a public hearing on the proposed <br />Conditional Use Permit amendment on September 2, 2025; and <br />WHEREAS: the Centerville Planning and Zoning Commission has submitted its report and <br />recommendation of approval to the City Council as part of a staff report dated April 7, 2026; and <br />WHEREAS: the City Council considered a Conditional Use Permit amendment at its April 16, 2026, <br />meeting and made the following findings of fact: <br />1.That the applicant has submitted requests to the City of Centerville for a Conditional Use Permit <br />(CUP) in accordance with the procedures as established by CentervilleÓs City Code; and <br />2.A Conditional Use Permit is required under City Code Section 156.166 (E) for property owners <br />to receive flexibility to the number of required parking stalls in City Code; and <br />3.That the request for flexibility is consistent with the overall goals and objectives of the <br />Centerville Comprehensive Plan; and <br />4.That the proposed flexibility is necessary to reasonably establish a new commercial retail use on <br />the property, and the use is expected to contribute to the general welfare of the City; and <br />5.That the request would allow for flexibility to parking standards which will not have a <br />substantial or undue adverse effect on adjacent property, the character of the surrounding <br />neighborhood and the general health, safety, and welfare of the City; and <br />6.That the proposed flexibility, with conditions as imposed by the City, will allow for <br />establishment of a retail use which is arranged and operated in accordance with applicable <br />regulations. <br />1 <br />69 <br /> <br />
