NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CENTERVILLE <br />RESOLVES AND DIRECTS AS FOLLOWS: <br />The Conditional Use Permit request by FGS Properties for the Property is hereby approved with the <br />following conditions: <br />1.This Conditional Use Permit is intended to allow flexibility to the standards for retail uses only. <br />Should another use requiring flexibility to the parking standards be proposed, an amendment to <br />the CUP is required. <br />2.The Retail use may include a maximum of 30% of the floor area for walk in customer sales. If a <br />higher amount of floor area is desired for walk in sales, an amendment to the CUP is required. <br />3.Parking area improvements shall not be located within any drainage and utility easement areas <br />unless otherwise approved by the City. <br />4.Use of the parking area is limited to the daily parking of operable, licensed, vehicles unless <br />otherwise approved by the City. <br />5.Prior to establishing the retail use, the Property Owner must bring the parking lot into conformance <br />with City standards for poured in place curbing and bituminous surface. <br />6.The Applicant must obtain and maintain all applicable permits and licenses to improve the property <br />and operate the commercial use on the subject property. <br />ADOPTED by the City Council of the City of Centerville, Minnesota, this ____ day of ____, 2026. <br />_________________________ <br />Nancy Golden, Mayor <br />ATTEST: <br />_________________________ _________________________ <br />Teresa Bender, City Clerk Dated <br />2 <br />70 <br /> <br />
