City of Centerville <br />Planning and Zoning Commission <br />April 7, 2026 <br /> <br />CUP Amendment Findings <br />Staff recommend the following findings supporting approval of the CUP: <br />1. That the applicant has submitted requests to the City of Centerville for a Conditional Use <br />Permit (CUP) in accordance with the procedures established by CentervilleÓs City Code; and <br />2. A Conditional Use Permit is required under City Code Section 156.166 (E) for property <br />owners to receive flexibility to the number of required parking stalls in City Code; and <br />3. That the request for flexibility is consistent with the overall goals and objectives of the <br />Centerville Comprehensive Plan; and <br />4. That the proposed flexibility is necessary to reasonably establish a new commercial retail <br />use on the property, and the use is expected to contribute to the general welfare of the City; <br />and <br />5. That the request would allow for flexibility to parking standards which will not have a <br />substantial or undue adverse effect on adjacent property, the character of the surrounding <br />neighborhood and the general health, safety, and welfare of the City; and <br />6. That the proposed flexibility, with conditions as imposed by the City, will allow for <br />establishment of a retail use which is arranged and operated in accordance with applicable <br />regulations. <br /> <br />CUP Conditions <br />Staff recommend the following conditions of approval for the CUP: <br />1. This Conditional Use Permit is intended to allow flexibility to the standards for retail uses <br />only. Should another use requiring flexibility to the parking code be proposed, an <br />amendment to the CUP is required. <br />2. The Retail use may include a maximum of 30% of the floor area for walk in customer sales. <br />If a higher amount of floor area is desired for walk in sales, an amendment to the CUP is <br />required. <br /> <br />Discussion ensued about what would happen if the business wanted to expand. City Planner Fuerst <br />noted that if they wanted to have more walk-in sales, they could amend their CUP. The proposed <br />CUP is based on 30% of gross retail floor space for walk in business. <br /> <br />The Commission is in favor of recommending that council approve the CUP, along with the findings <br />of fact and conditions. <br /> <br />Motion by Commissioner Thompson, seconded by Commissioner Seppala, to recommend the <br />Council approve the request by FSG properties, LLC for a conditional use permit amendment <br />allowing flexibility to parking standards with the findings and conditions proposed by staff. <br />All in favor. Motion carried. <br /> <br /> <br />VIII. APPROVAL OF MINUTES <br />1. April 7, 2026, Planning and Zoning Commission Meeting <br />Administrator Lewis introduced this item as presented in the packet. <br /> <br />Motion by Commissioner Thompson, seconded by Commissioner Seppala to approve the <br />minutes as presented.
