<br />Mayor Swedberg asked who the City representative was on the site. Mr. Peterson <br />indicated that Dan was the inspector but was not out at the site all the time. <br /> <br />Mayor Swedberg stated that in the future the City Administrator should be notified of any <br />anticipated overruns so that the process can be stopped and renegotiated, if possible. <br /> <br />Council Member Broussard Vickers indicated that the contractor had no incentive to do <br />so. <br /> <br />Council Member Capra asked if the City would have the right to bring in another <br />contractor for that type of work if the amount was projected to be more than was <br />approved. City Attorney Hoeft indicated that it would depend on the wording of the <br />contract. <br /> <br />Council Member Travis indicated he was not disputing how the contractor arrived at the <br />per cubic yard price but stated he does not feel that his equipment costs tripled. He also <br />noted that the job that was done was completely different than the job that was bid. <br /> <br />Council Member Nelson noted that Council would remember this overage when <br />receiving bids in the future <br /> <br />VOTE: All in favor. Motion carried unanimously. <br /> <br />3. Holiday Party (Update) <br /> <br />Ms. Moore-Sykes indicated that after talking to Staff it was detern1ined that the <br />employees would like to close the office at noon on December 24,2001 and/or hold a <br />potluck at City Hall. <br /> <br />Council Member Nelson indicated she would be fine with having the potluck on <br />December 24, 2001 and letting the employees go home afterwards. <br /> <br />It was the consent of Council to have a potluck on December 24, 2001 and send <br />employees home afterwards. <br /> <br />4. Gassen Companies - Street Lights (Eagle Pass Townhomes) <br /> <br />Ms. Moore-Sykes indicated she is continuing to work on this matter and had submitted a <br />letter to Gassen Companies. She also indicated that Mr. Palzer is waiting for information <br />from NSP concerning whether or not it is possible to increase the wattage of the light <br />bulbs in the lights. <br /> <br />Council Member Nelson asked if the City could take over a strip of property from the <br />Association in order to provide a trail for the senior citizens in the area. City Attorney <br />Hoeft indicated that the City could take over property by eminent domain if it is for a <br /> <br />Page 4 of 10 <br />
