She then indicated that the <br />elderly housing should not have been put in without access. <br /> <br />Council Member Broussard Vickers indicated there was a 20 foot wide drainage <br />easement through the property. <br /> <br />Ms. Peterson commented that the Association could not afford the liability for all the <br />elderly people coming from the senior housing and crossing Ojibway Drive to Dupre <br />Road. <br /> <br />Mr. Brian Carlson of 1771 Meadow Lane reminded Mr. Quigley that he had agreed to <br />push Units 9 and 10 forward 10 feet. Mr. Quigley agreed to do so. <br /> <br />Mayor Swedberg complimented Mr. Quigley on his efIorts to blend the development in <br />and his efforts to address the issues of the existing development. <br /> <br />Ms. Lori Peterson of 7065 Dupre Road indicated that the motion that was made at the <br />Planning and Zoning meeting included the addition of the association requested items <br />which were trees, trailway through the outlot, concerns with screening and a written <br />guarantee for Ojibway Drive. <br /> <br />Mayor Swedberg indicated that those sorts of items are handled in the developer's <br />agreement. <br /> <br />Ms. Peterson asked when residents would have input into the developer's agreement. <br />City Attorney Hoeft indicated that the details would be approved when the final plat is <br />approved. <br /> <br />Mayor Swedberg asked Ms. Moore-Sykes to notify the Association when the final plat is <br />before Council for final plat approval. <br /> <br />Council Member Broussard Vickers asked whether it was appropriate to put the road <br />agreement in the developer's agreement or whether it should be between the Association <br />and the developer. City Attorney Hoeft indicated he did not want the road in the <br />developer's agreement. <br /> <br />Council Member Broussard Vickers questioned whether the Association's only recourse <br />is a civil suit if the City approves the development and the road is damaged. <br /> <br />City Attorney Hoeft indicated the Association would have civil recourse and said the City <br />would not condition approval of the development on the agreement between the <br />developer and the Association. <br /> <br />Council Member Broussard Vickers asked how the Association could prevent access to <br />the road. City Attorney Hoeft indicated he was not prepared to give the Association legal <br /> <br />Page 9 of 25 <br />
