He then commented that the City should not dictate how the <br />Association governs its roads. <br /> <br />Mr. Quigley indicated that he has committed several times in a public forum and again in <br />written form that any street damage would be taken care of for a period of two years. He <br />then indicated that he had another letter with him at the meeting that he was prepared to <br />give to the Association. <br /> <br />City Attorney Hoeft clarified that approval of the final plat would be contingent upon <br />Units 9 and 10 being moved forward 10 feet. He then indicated that Council needed to <br />detennine whether the new street on the eastern side of the proposed development would <br />be public or private. <br /> <br />Council Member Broussard Vickers asked the Association if they wished to have the <br />road public or private. <br /> <br />Bert Casper of 6979 Dupre Road indicated he did not want any more private roads in the <br />development. <br /> <br />Council Member Broussard Vickers indicated she was not in favor of adding another <br />private street when the current private street has caused so many problems. <br /> <br />Mayor Swedberg indicated he was fine with requiring the street be public. <br /> <br />Ms. Lori Peterson of 7065 Dupre Road indicated that the extension to Ojibway Drive has <br />to be supported by 18 current units and 12 potential new units and the proposed other <br />private road is supported by 65 units. She then commented that it does not make sense to <br />allow a private street to be supported by so few residents especially since they are all <br />paying taxes and do not receive a break for the services the City does not provide to <br />them. <br /> <br />Mayor Swedberg indicated he understood Ms. Peterson's point but indicated that the <br />private street was in the agreement when she bought her house and she should have been <br />aware of it. <br /> <br />Motion bv Council Member Nelson, seconded by Council Member Travis to <br />approve the Preliminary Plat for Eagle Pass 2nd Addition contingent upon moving <br />Units 9 and 10 forward 10 feet and the new road to the east ofthe proposed <br />development being wide enough to be a public road. <br /> <br />Council Member Broussard Vickers commented that a few residents are burdened with <br />the private road and the City is adding to it. She indicated that, if the City is not <br />interested in taking over the road, the entrance should have been re-drawn to allow for <br />entrance off of a public road. She further indicated that she was not against the <br />development but feels the City is intensifying an existing problem by allowing the <br />development to continue with the extension of the private road. <br /> <br />Page 10 of25 <br />
