<br />Council Member Nelson indicated there were several steps necessary before final plat <br />approval would be given. <br /> <br />Mr. Rehbein indicated he was hoping to have final plat approval by the middle of <br />December so that he could close on the property. <br /> <br />Council Member Nelson indicated she was fine with approving the preliminary plat as <br />long as it is made clear that there needs to be some kind of bonding for the road. She <br />then indicated that the City is considering bringing water to that development and noted <br />that a large portion of the cost to do so would be Mr. Rehbein's responsibility. <br /> <br />Council Member Broussard Vickers noted she felt that the middle of December was an <br />aggressive time line for final plat approval because, even if Council ordered the <br />feasibility study tonight, it would be the first week in December when the public hearing <br />would be held. She then suggested Mr. Rehbein should renegotiate his closing date. <br /> <br />Mr. Rehbein indicated that when the closing date was determined he did not think that <br />water was going to be an issue with this development. <br /> <br />Mayor Swedberg questioned whether the City had a policy of requiring that the City <br />Engineer do the engineering work involved with the development. <br /> <br />City Attorney Hoeft indicated that the City typically has the City Engineer do the work as <br />the developer or landowner does not usually have the expertise needed to do the work. <br />He then indicated he did not feel it was an issue to allow the developer to use his staff to <br />provide the documents, provided the developer is willing to pay for and be bound by the <br />inspection of the City Engineer. <br /> <br />Council Member Broussard Vickers indicated the City had never been asked to allow a <br />developer to do the engineering work. <br /> <br />Mayor Swedberg questioned whether Mr. Hannah would have asked to be allowed to use <br />his own engineer. <br /> <br />City Attorney Hoeft indicated that Mr. Hannah could have used his own engineer but said <br />that he feels that looking at the cost benefit analysis it was cheaper to use the City <br />Engineer in Mr. Hannah's case. <br /> <br />Mayor Swedberg thanked City Attorney Hoeft for his comments and indicated he did not <br />want to go against any City policy. <br /> <br />City Attorney Hoeft indicated that if Mr. Rehbein wanted his own attorney to draft the <br />developer's agreement he would have no problem with that. <br /> <br />Page 9 of 23 <br />
