<br />Mr. Hannah noted he was the developer of the Pheasant Marsh Development and <br />noted he was present to talk about the 429 process and the approvals necessary for <br />his development. He indicated Ms. Bender has been in contact with him <br />regarding the bond approval process. <br /> <br />Mr. Hannah noted the first item is submission for a local improvement with <br />Ground Development paying 100% of the assessments followed by waiver of <br />appeals. He explained there were changes in the assessment process, which <br />created additional documentation for the approval process. He indicated the <br />petition for a local improvement is very straightforward and stated Ground <br />Development would not have any problems with this paperwork. <br /> <br />Mr. Hannah explained that his attorney and president were both unavailable for <br />discussion on these items and asked if the Council could approve these items <br />contingent upon signature ofthe petition by the president tomorrow. <br /> <br />Mr. Hoeft stated he did not object to approve of these items contingent on the <br />signature being completed tomorrow. He indicated the petition for approval and <br />the agreement of assessments and waiver of irregularity and appeal should go <br />through with as is. <br /> <br />Motion bv Councilmember Nelson. seconded by Councilmember Capra <br />approvine: Resolution 01-014 and Resolution 01-015 contine:ent upon the <br />si2nature of the President of Ground Development. for the Petition for Local <br />Improvement and Ae:reement of Assessment; and Waiver of Irree:ularity and <br />Appeal by the Owner as presented bv staff. All in favor. Motion carried. <br /> <br />Barry Brainerd - Planning Commission <br /> <br />Barry Brainerd, 1853 Remore Street, noted he was before the Council with regard <br />to his third annual block party and stated he is requesting to put up barricades the <br />cul-de-sac near his home. Mr. Brainard drew a diagram of the proposed location <br />for the barricades to allow safety for those participating in the block party. <br /> <br />Mr. Brainard noted he spoke with the police department and public works <br />regarding this item. He indicated both approved his site location and noted he <br />was just looking for approval from the Council. <br /> <br />Councilmember Nelson asked if citizens would still be able to reach Acorn Creek <br />Park. Mr. Brainerd noted the roadway would still be open for a vehicle to pass, <br />but indicated he just wanted to minimize the flow. <br /> <br />Motion by Mavor Swedbere:. seconded by Councilmember Travis to approve <br />the barricade for Barry Brainard for the block party near 1853 Remore <br />Street from 3:00 pm to 12:00 am on Aue:ust 25. 2001.
