<br />MEMO <br /> <br />DATE: July 5, 2001 <br /> <br />TO : Honorable Mayor and Council <br /> <br />FROM: Jim March <br /> <br />RE : Eagle Pass Second Addition <br /> <br />............................................................................ <br /> <br />Included in your packet is a copy of the proposed preliminary plat for Eagle Pass Second <br />Addition. This item has been before Council at a previous meeting. <br /> <br />Mr. Mike Quigley (Gor-em Development) has met with representatives from the two <br />town-home associations. Many of the representatives from the associations were present <br />at the last Plarming and Zoning Commission meeting. A number of concerns were raised <br />such as inadequate street lighting in the existing development, lack of enforcement with <br />the developer and Swift Construction and long-term road maintenance. <br /> <br />Many of the association members indicated that they plan on attending the next Council <br />meeting. Their primary issue appears to be having Ojibway Drive revert from a private <br />road to a public street. They would like to reiterate to the Council why they believe the <br />street should be public and not private. <br /> <br />The Planning and Zoning Commission appeared to be comfortable with the preliminary <br />plat, however no action was taken on the item. The Planning and Zoning Commission <br />passed a motion to continue the public hearing to the next Council meeting to discuss the <br />public/vs. private road issue. The twin-home association president commented that <br />having both single and twin town-homes in the same association would make it difficult <br />to administer the dues for long term road maintenance. <br /> <br />I will ask Mr. Hoeft to be prepared to answer some of the legal questions that were raised <br />at the Planning and Zoning Commission meeting. <br />
