<br />June 27, 2001 <br />Council Meeting Minutes <br />Council Member Nelson questioned if a benefit could be determined or appraised <br />for these properties. Mr. Hoeft indicated by setting 100% of the benefit to the <br />developer no contest would be brought up, but then indicated the development <br />may not go through if the developer won't agree to pay 100%. <br /> <br />Mr. Hoeft explained the Ground Development attorney forwarded a Developer's <br />Agreement to the City but noted revisions were being made at this time. He <br />stated the percentage of distribution of assessments would be made a part of the <br />agreement after discussions with the developer. <br /> <br />Council Member Broussard Vickers asked if the original time line was included <br />within the Developer's Agreement. Mr. Hoeft stated a time line has not been <br />agreed to as of yet, but stated all things could change, depending on if the <br />developer and City can come to terms with the assessments. <br /> <br />Council Member Broussard Vickers noted she would just like to see a "no <br />sooner" date placed within this agreement. Mr. Hoeft stated this should not be an <br />issue as they work through the Developer's Agreement. <br /> <br />Council Member Nelson indicated she felt it would be helpful if all parties <br />involved come together and work with the City Attorney and staff to resolve the <br />assessment issues. <br /> <br />Mr. Hoeft asked that the Council table the public hearing to a future date when the <br />matter can be brought back to the Council, when further information is gathered. <br /> <br />Motion by Council Member Capra. seconded by Council Member Nelson to <br />table the public hearing to a future date to allow for assessment discussions <br />with Ground Development. All in favor. Motion carried unanimously. <br /> <br />Mayor Swedberg called for a five-minute recess at 7:43 p.m. The meeting <br />resumed at 7:51 p.m. <br /> <br />IV. APPEARANCES/AWARDS <br /> <br />Tom Kuehn - Permit Discussion <br /> <br />Mr. Kuehn indicated he was before the Council to request a road permit to allow <br />for a nine-ton vehicle on Heritage Street to allow for him to bring materials into <br />St. Genevieve's Church building. <br /> <br />Mr. Peterson noted he had no objections as the road was already in poor condition <br />at this time. <br /> <br />Motion bv Council Member Capra. seconded by Council Member Travis to <br />aporove Mr. Kuehn's request to carry five to six loads over Heritage Street <br />at a nine-ton load limit.
