Statement bv Meetinq Chai~~erson: <br /> <br />At this stage of tne proceedings we are to discuss only <br />the issue of whethe~ or not it has been proved that a <br />violation .of the Huge City Code has occurred. We need to <br />proceed to reach Consensus as to that issu~ at this time. <br /> <br />At some point, a. motion should be made alternatively a,s! I ~J <br />follows: q \lla ~ <br /> <br />"I hereby move that this Council maJte a finding that/HUgO <br />City Code Chapter 150, Section 4, Subd. 1 has/has not <br />{strike one} been proved based upon the information <br />received by the Council at this hearing.;' <br /> <br />B. The Chair of the meeting should seek a second for the <br />motion. <br /> <br />C. The Chair shall call twice for further discussion on the <br />motion. <br /> <br />D. The Chair shall take & roll call vote on the rnocion. <br /> <br />V. Furcher Council Action. <br /> <br />A. <br /> <br />If a majority of the Council has voted <br />~llegation has not btaen proved, then the Chair <br />a motion, second and vote that the proceeding <br />and that the case be concluded. <br /> <br />that the <br />shall seek <br />be closed <br /> <br />B. If a majority of the council has voted that the <br />~llegation has been proved, then the Chair shall proceed <br />to the next section of this outline. <br /> <br />VI. <br /> <br />Qonsideration of Civi1 Penal~. <br /> <br />Statement by chair: <br /> <br />In considering the issue of th~ proper Civil Penalty to <br />be imposed, if any, you should be aware of the legal <br />framework we are working in. Specifically, Hugo City <br />Code Chapter 150, Section 12, Subd. 1 addresses civil <br />penalties as follows: <br /> <br />FailurE!. to Comply \,\lith the Law. The Council <br />shall either suspend for a period up to sixty <br />(60) days, or revoke, any liquor licen$e, or <br />im~ose a civil fine not to exceed $ 2,000.00 <br />for each violation upon finaing the ~icensee <br />has failed to cornpl~ with any a?plicable <br /> <br />:j <br />
