City of Centerville <br />City Council Meeting Minutes <br />November 29, 2006 <br />Legal Counsel Glaser reported that ACLU voted unanimously to sue Taylor Falls, testing <br />the sex offender ordinance, and he advised Council delay any judgment until the lawsuit <br />was settled. <br /> <br />It was Council consensus to wait, as suggested by Legal Counsel. Council Member Lee <br />inquired as to how long the lawsuit would take. Legal Counsel Glaser responded that it <br />would likely progress to the U.S. Supreme Court. <br /> <br />2. Administrative Fines <br /> <br />Mayor Capra offered a brief history on administrative fines and then requested the Legal <br />Counsel’s report. <br /> <br />Legal Counsel Glaser reported that there had been movement in the last two sessions of <br />Legislature to allow cities to determine non-moving violations and that Governor <br />Pawlenty had added a $72 fee to every court case, helping to result in the State’s current <br />$2 billion surplus. He advised, with the massive Anoka County computer changeover in <br />March that will affect police and prosecution departments, that revised fines be updated <br />in January or mid summer. <br /> <br />Mayor Capra commented that the expense would be getting ticket books changed, then <br />also noted her objection to the fine for climbing on trees. <br /> <br />City Administrator Larson stated that Council may want to see if additional things should <br />be added, noting two or three things that were not on the list. He said there may be <br />sufficient time to make amendments before January. Legal Counsel Glaser suggested <br />getting the bugs worked out as soon as possible, and Mayor Capra expressed favor for <br />doing so. <br /> <br />Motion by Council Member Lee, seconded by Council Member Lakso, to approve a <br />resolution re-establishing penalties for administrative offenses within the City of <br />Centerville. All in favor. Motion carried unanimously. <br /> <br />3. Resolution #06-050 – Accepting Bids and Awarding Project Block 7 <br />Redevelopment (Grading and Utility Improvements Project) <br /> <br />City Administrator Larson reported that a resolution was needed for the award to <br />Precision Excavating & Grading, LLC. <br /> <br />Motion by Council Member Terway, seconded by Council Member Paar, to <br />approve Resolution #06-050 awarding Project Block 7 Redevelopment to Precision <br />Excavating & Grading, LLC All in favor.
