<br />ORDINANCE #53 <br />page four <br /> <br />40.02-6 <br /> <br />40.02-7 <br /> <br />40.02-8 <br /> <br />The Clerk/Administrator may impose conditions <br />which it considers necessary to meet the standards <br />of this ordinance and to protect the best interest <br />of the surround area or the city as a whole. <br />Violation of such condition is a violation of this <br />ordinance. <br /> <br />If the Clerk/Administrator denies the License it <br />shall include in its recommendations or <br />determination findings as to the ways in which the <br />proposed use does not comply with the standards <br />required by this ordinance. <br /> <br />The applicant may appeal the decision of the <br />Clerk/Administrator with the City Council. <br /> <br />Section 40.03 Duration of license. <br /> <br />40.03-1 Each license shall be valid only for the period <br />specified and no license may extend beyond the <br />thirty-first day of December of the year in which <br />it is granted. <br /> <br />40.03-2 <br /> <br />Transient Merchant sales shall not <br />(8) days within a maximum period <br />months. <br /> <br />exceed eight <br />of six (6) <br /> <br />Section 40.04 License not transferable. <br />All licenses shall be nontransferable. No refunds shall be <br />made on unused portions of licenses except by resolution of <br />the Council. Each peddler, solicitor, or transient merchant <br />shall secure a separate license. <br /> <br />Section 40.05 License to be carried. <br />All licenses shall be carried by the licensee or <br />conspicuously posted in the licen~ee's place of business and <br />the license shall ~e exhibited to any officer or citizen <br />upon such officer's or citizen's request. <br /> <br />Section 40.06 License revocation. <br />Any license may be revoked by the Council for a violation of <br />any provision of this ordinance, if the licensee has been <br />given a reasonable notice and an opportunity to be heard. <br /> <br />Section 40.07 Approval. <br />City Council (Allow <br />when approved by <br />second and fourth <br />must be received <br />meeting. ) <br /> <br />2-3 weeks from date of application to <br />Council. City Council meetings are the <br />Wednesday of each month and application <br />at least 2 weeks prior to the Council <br />
