<br />March 28, 200 I <br />Council Meeting Minutes <br /> <br />advisory Committee that makes recommendations to Council, with Council making <br />decisions. <br /> <br />Council Member Travis stated he had no problem appointing Ms. Scott to the Committee. <br />Council Member Capra stated she felt strongly that Ms. Scott should not be on the <br />Committee. Mayor Swedberg concurred that Ms. Scott had a large amount of knowledge <br />the City could benefit from; however, she also had financial and contractual interest. <br />Mayor Swedberg also concurred with Council Member Capra regarding conflict of <br />interest. <br /> <br />Motion by Council Member Nelson. seconded by Council Member Capra to appoint <br />Ms. Theresa Brenner. Mr. Tom Fairbrother. Mr. Loren Abrahamson. Mr. Craig <br />Bode. and Ms. Andrea Witzel to the Communications Ad Hoc Committee. <br />Nds.~ <br />Council Member Travis questioned how Council Member ~ could move to keep <br />someone off the Committee after making a statement that she did not really know any of <br />the people recommended. <br /> <br />Council Member Broussard Vickers stated the Committee Chair had requested approval <br />of the individuals on the list, noting that there are others who may also have a financial <br />interest Council Member Broussard Vickers felt that Council should support the <br />recommendation of Ms. Brenner and stated that she finds it incredible that Council <br />Members have chosen to pick Ms. Scott as the one (1) to tighten up the rules on. <br /> <br />Mayor Swedberg stated that the League of Minnesota Cities states that a person cannot <br />make decisions if they have a contractual interest. <br /> <br />Mr. Hoeft stated that the Committee is an advisory board and members of same are <br />required to disclose any financial interest they may have, even though it technically is not <br />a conflict of interest. <br /> <br />Mayor Swedberg stated he believed Council, commission/committees are bound by the <br />same rules. Mr. Hoeft explained that commission/committee volunteers are bound to <br />disclosure financial interests and should abstain from discussion or voting on an item if <br />they feel it is appropriate; however, they are not required to do so. Mr. Hoeft stated that <br />if Council acted on an item forwarded from a commission/committee where an individual <br />had not disclosed a financial interest and did not abstain from the voting process, that <br />individual would be held responsible for their action. <br /> <br />Council Member Nelson stated that after hearing the advice of Mr. Hoeft she perceives <br />Ms. Scott to have a conflict of interest. <br />+ <br /> <br />All in favor . Ayes - ~ (Mayor Swedberg. Council Members Capra. Nelson and <br />Vickers) Nays -1 (Council Member Travis). Motion carried. <br /> <br />Motion by Council Member Broussard Vickers. seconded by Council Member <br />Travis to appoint Ms. Scott to the Communications Ad Hoc Committee.
