MEMO

DATE: January 5, 2001

TO : Honorable Mayor and Council

FROM: Jim March

RE : Joyce A. Stevens - Rezone from R2 to 11 (7007 20th Avenue)

************************************************************************

A public hearing was held at the last Planning and Zoning Commission meeting in
regards to rezoning the property located at 7007 20th Avenue. The property is currently
zoned residential. The comprehensive plan shows the property guided for commercial.
The property owner is requesting to rezone the entire parcel to Industrial.

The property currently has a single family home on the west end of the property and a
green pole barn on the east side of the property that can be seen from 20th Avenue.
Muellner Blacktop is a tenant in the pole barn. Muellner Blacktop would like to purchase
the entire property.

Several residents were in attendance to oppose the rezoning. It appeared the consensus
was that there were no issues with the present tenant in the building, but there was
concern for what type of future businesses could be allowed with industrial zoning.

After lengthy discussion, the Planning and Zoning Commission voted to deny the
rezoning request. It appeared that the tenant might still pursue purchasing the property
and continue to operate his business through the pursuit of a special use pennit.
