<br />Effective 9/5/00 <br />City of Centerville Ord. #4 <br /> <br />determine whether certain provisions in this Ordinance are affected by <br />other Ordinances. <br /> <br />Division 25: Lot Provisions <br /> <br />Lots of Record <br /> <br />A. No lot of record shall be reduced in size below the district <br />requirements in Section 080-030; and <br /> <br />B. An existing lot of record shall be deemed a buildable lot even though <br />the lot area and/or dimensions are less than those required for the <br />district provided as follows: <br /> <br />1 . Evidence must be presented that the lot in <br />question met minimum requirements for the <br />division of property under ordinance regulations <br />in effect at the time of the division of property; <br />and <br /> <br />2. It fronts on a public street; and <br /> <br />3. The lot is within seventy percent (70%) of the <br />minimum lot area and lot width required. <br /> <br />C. If two (2) or more lots are in single ownership and if all or part of the <br />lots do not meet the width and area requirements of this Ordinance, <br />the contiguous lots shall be considered to be an undivided parcel for <br />the purpose of this Ordinance. <br /> <br />Division 30: Non-Conforming Uses and Structures <br /> <br />Any structure or use existing upon the effective date of the adoption of this Ordinance <br />which does not conform to the provisions of the Ordinance may be continued subject to the <br />following conditions: <br /> <br />A. The non-conforming use is not expanded or enlarged, except in <br />conformity with the provisions of this Ordinance; and <br /> <br />B. If a non-conforming use is discontinued or a non-conforming structure <br />is abandoned for a period of six (6) months, further use of the <br />structure or property must conform to this Ordinance; and <br /> <br />C. If a non-conforming use is replaced by another use, the new use shall <br />conform to this Ordinance; and <br /> <br />Page 16 of62 <br />
