<br />District Boundaries. <br /> <br />D. After the filing of an application, or initiation by the City Council, the <br />City Clerk shall set a date for a public hearing. Notice of the hearing <br />shall be posted and published at least ten (10) days prior to the date <br />of the hearing, and notice shall be mailed to each property owner <br />within three hundred fifty (350) feet of the proposed Zoning District <br />Boundary amendments. <br /> <br />E. Upon hearing the request, the Planning and Zoning Commission shall <br />recommend either approval or denial the proposed amendment and <br />shall state the reasons of said action. <br /> <br />F. Within thirty (30) days of the recommendation of the Planning and <br />Zoning Commission, the City Council shall consider the <br />recommendation of the Planning and Zoning Commission and shall <br />approve, deny or modify the request to amend this Ordinance. <br /> <br />Division 205: Special Use Permits <br /> <br />Section 205-010: Procedure. A Special Use Permit may be issued in accordance with <br />this Section for any use or purpose for which such permits are required or permitted by this <br />ordinance. Application for a special use permit shall be made by the owner to the Planning <br />Commission on a form prescribed by the Commission and accompanied by such other <br />information as required by rules of the Commission. The Planning Commission may hold <br />such hearings on the proposal to issue a special use permit as it considers necessary and it <br />shall thereafter make such recommendations on the proposal to the Council as it deems <br />advisable. Upon receipt of such recommendations, the Council shall hold whatever <br />hearings it deems advisable and shall make its decision upon the proposal to grant a <br />special use permit. <br /> <br />Section 205-020: Standards. The Planning Commission shall recommend a Special Use <br />Permit and the Council shall order the issuance of such permit only if it finds that such use <br />at the proposed location will be consistent with the general and applicable specific <br />objectives of the comprehensive plan and this Ordinance, will be harmonious and <br />appropriate in the area, will not be hazardous or disturbing to neighboring uses, will not <br />result in traffic congestion, and will not create excessive additional public expense. <br /> <br />Section 205-030: Denial for Non-Compliance. If the Planning and Zoning Commission <br />recommends denial of a Special Use Permit or the Council orders such denial, it shall <br />include in its recommendations or determination findings as to the ways in which the <br />proposed use does not comply with the standards required by this Ordinance. <br /> <br />Section 205-040: Conditions. In recommending or approving any Special Use <br />Permit, the Planning and Zoning Commission and the Council may impose conditions <br />Page 63 of 65 <br />
