N.W., ANDOVER, MINNESOTA 55304-4005 <br />(763) 862-4200 FAX (763) 862-4201 <br /> <br />September 8, 2005 <br /> <br />Mr. Dallas Larson <br />Administrator <br />City of Centerville <br />1880 Main Street <br />Centerville, MN 55038 <br /> <br />Dear Mr. Larson: <br /> <br />This letter is in response to your letter dated August 10, 2005 that pertained to questions <br />on the revised Memorandum of Understanding (MOU) that I forwarded to you on July 29,2005. <br /> <br />With regards to right-of-way issues, we would define the term "uneconomic remnant" to <br />be a parcel of land that is not large enough to be buildable under current zoning regulations. For <br />example, if we need to purchase an entire parcel even though our highway right-of-way needs <br />are only across a portion of the property, we will keep the portion of the property we need for <br />highway purposes and dispose of the excess portion. Generally, ifthe excess portion is so small <br />that no reasonable building could be constructed on it under zoning regulations, then this excess <br />property will be conveyed to the City subject to specific negotiations with affected property <br />owners. If the excess portion of the property is large enough for a reasonable building <br />improvement, then Anoka County will remarket the property. In this case, we would offer the <br />City the rights to buy this property at appraised market value before we offer this to the public. <br /> <br />The second paragraph under the "Traffic Signals" section of the MOU has been revised <br />to show that the intersection of 21 st Avenue with CSAH 14 will operate as a "% -access" <br />intersection until such time that a new interchange at I-35E is constructed. The % -access will <br />allow both left and right turning movements from CSAH 14 onto 21 st Avenue in both directions. <br />Turning movements for both southbound and northbound 21 st Avenue onto CSAH 14 will be <br />limited to right-out only. Upon the construction of a new or partially new interchange at I-35E, <br />the access at CSAH 14/21 st Avenue will be limited to right-inlright-out only. <br /> <br />Determining whether or not the County would participate in a backage road between 20th <br />and 21 st Avenues can only be determined during final design of our project and after an analysis <br />of the construction staging for CSAH 14 has been completed.
