<br />ornamental towers and spires, chimneys, elevator bulkheads, <br />smokestacks, conveyors, flagpoles, silos, and air conditioning and <br />heating units. <br /> <br />(d.) No tower, gable, spire, or similar structure shall be used for sleeping or <br />eating quarters, or for any commercial purpose except one (I) incidental <br />to the permitted uses ofthe main building. <br /> <br />422.06 Swimming Pools. Swimming pools are defined as any structure, basing chamber or tank, <br />used for swimming or bathing, over 24 inches in depth, and that is constructed about or <br />below ground. Swimming pools may exceed the size requirements for accessory <br />structures as described in this Section, but they cannot exceed fifty percent (50%) of the <br />rear yard. <br /> <br />Subd. I. <br /> <br />Easements. No part of a swimming pool may be located within any <br />private or public utility, workway, drainage, or other easement. <br /> <br />Subd. 2. <br /> <br />Setbacks. No part ofa swimming pool may be located within five (5) <br />feet of the side yard property line or within ten (l0) feet of the rear yard <br />property line or within 75 feet from the natural high water elevation of a <br />lake. <br /> <br />Any swimming pool mechanical equipment, including the filter unit, <br />pump, heating unit, must be at lease 25 feet from any neighboring <br />residential structure; at least ten (l0) feet from any side yard property <br />line; and at least 75 feet rrom the natural high water elevation of a lake. <br /> <br />Subd.3. <br /> <br />Front Yard. No swimming pool may be located in a front yard. <br /> <br />Subd. 4. <br /> <br />Safety Requirements. Safety precautions must be at a minimum to <br />comply with the following: <br /> <br />(a) All pools must be provided with safeguards to prevent children rrom <br />gaining uncontrollable access. Safeguards must include a fence at <br />least six (6) feet in height designed to reasonable prevent <br />uncontrolled access by children. <br /> <br />(b) All fence openings or points of entry into the pool area enclosure <br />must be equipped with a gate, and all gates must be equipped with <br />self-latching devices placed so as to be inaccessible to small children. <br />The gates must be locked at all times when the pool is not in direct <br />use. <br /> <br />Subd.5. <br /> <br />Lighting. Lighting used in connection with swimming pools must be <br />adjusted in a manner as not to interfere with the reasonable use of <br />adjacent property. <br /> <br />4 <br />
