<br />PURPOSE <br /> <br />It is the purpose of this interim ordinance to place temporary restrictions on all <br />Slaughterhouse/Butcher Shop Operation(s) within the City ofCenterville. <br /> <br />BACKGROUND <br /> <br />There is concern that the current Ordinance #4 provisions exclude such permitted usage <br />within any Zoning District in the City of Centerville. <br /> <br />The City Council has initiated the study of possible provisions that need to be contained <br />in Ordinance #4 if such an operation was to take place within the City. The City is in the <br />process of reviewing studies and information from additional communities and upon <br />completion of this review, will make the necessary revisions to Ordinance #4 for such <br />operation and location of the same if deemed appropriate by Council. <br /> <br />AUTHORITY <br /> <br />Pursuant to Minnesota Statutes, Section 462.365, Subd. 4, The City is authorized to <br />establish Interim Ordinances to regulate, restrict or prohibit any use or development in all <br />or part of the City while the City or its planning consultant is conducting studies, or has <br />authorized a study to be conducted or has scheduled a hearing to consider adoption or <br />amendment of the comprehensive plan or official zoning controls. The City declares that <br />this Interim Ordinance is established pursuant to the aforementioned statute. <br /> <br />PROHIBITION <br /> <br />Pursuant to the authority of Minnesota Statutes, 462.355, Subd 4; there is hereby <br />established a moratorium on slaughterhouselbutcher shop operation(s) that also include <br />custom butchering for ritualistic, rituals or sacrifice within in any zoning district in the <br />City of Centerville. <br /> <br />During the effective period of this Interim Ordinance, applications for amendments to <br />Ordinance #4 or Special Use Permits for the above-mentioned use shall not be accepted, <br />considered or approved by the City. This Interim Ordinance prohibits the further <br />consideration and approval of any amendment or Special Use Permit request for the <br />above-mentioned use. <br /> <br />MISDEMEANOR <br /> <br />Any person, persons, firm or corporation violating any provisions of this ordinance shall <br />be guilty of a misdemeanor, and upon conviction thereof, shall be punished pursuant to <br />Minnesota Statute 609.02, Subd. 3, or as subsequently amended, plus costs of <br />prosecution. <br /> <br />ENFORCEMENT <br />
