<br />Section 6.05 Inspection of Facility After Completion. Upon reasonable request by the <br />State Entity the Public Entity shall allow, and will require any entity to whom it leases, subleases, <br />or enters. into a Use Contract for any portion of the Real Property and, if applicable, the Facility <br />to allow, the State Entity to inspect the Real Property and, if applicable, the Facility. <br /> <br />Section 6.06 Data Practices. The Public Entity agrees with respect. to any data that it <br />possesses regarding the Grant, the Project, or the Real Property and, if applicable, the Facility, to <br />comply with all of the provisions and restrictions contained in the Minnesota Government Data <br />Practices Act contained in Chapter 13 of the Minnesota Statutes that exists as of the date of this <br />Agreement and as such may subsequently be amended, modified or replaced from time to time. <br /> <br />Section 6.07 Non-Discrimination. The Public Entity agrees to not engage in <br />discriminatory employment practices in the completion of the Project, or operation or <br />management of the Real Property and, if applicable, the Facility, and it shall, with respect to such <br />activities, fully comply with aU of the provisions contained in Minn. Stat. ~~ 363.03 and 181.59 <br />that exists as of the date of this Agreement and as such may subsequently be amended, modified <br />or replaced from .time to time. . <br /> <br />Section 6.08 Worker's Compensation. The Public Entity agrees to comply with all of <br />the provisions relating to worker's compensation contained in Minn. Stat. ~~ 176.181 subd. 2 <br />and 176.182 that exists as of the date of this Agreement and as such may. subsequently be <br />amended, modified or replaced from time to time, with respect to the completion of the Project, <br />and the operation or management of the Real Property and, if applicable, the Facility. <br /> <br />Section 6.09 Antitrust Claims. The Public Entity hereby assigns to the State Entity and <br />the Commissioner of Finance all claims it may have for over charges as to goods or services <br />provided in its completion of the Project, and operation or management of the Real Property and, <br />if applicable, the Facility that arise under the antitruSt laws of the State of Minnesota 'or of the <br />United States of America. <br /> <br />Section 6.10 Review of Plans and Cost Estimates. The Public Entity agrees to comply <br />with all applicable provisions and requirements contained in Minn. Stat. ~ 16B.335 that exists as <br />of the date of this Agreement and as such may subsequently be amended, modified or replaced <br />from time to time, for the Project, and in accordance therewith the Public Entity'and the State <br />Entity agree to comply with the following provisions and requirements if such provisions and <br />requirements are applicable. <br /> <br />A. The Public Entity shall provide all information that the State Entity may request <br />in order for the State Entity to determine that the Project will comply with the provisions <br />and requirements contained in Minn. Stat. ~ 16B.335 that exists as of the date of this <br />Agreement and as such may subsequently be amended, modified or replaced from time to <br />time. <br /> <br />B. Prior to its proceeding with design activities for the Project the Public Entity <br />shall prepare a predesign package and submit it to the Commissioner of Administration for <br />the State of Minnesota for review and comment.
