CITY INSTALLED IMPROVEMENTS. The City shall install and Developer <br /> <br />shall pay for the following improvementS ("Public Improvements") as required by the <br /> <br />Construction Plans: <br /> <br />A. Sanitary Sewer System <br />B. Water System <br />C. Storm Sewer <br />D. Streets . <br />E. Concrete Curb and Gutter <br />F. Ponding as described in Bid Alternate #1 for the Old Mill Road Street <br />Improvement Project <br /> <br />The Developer hereby requests that the City install the necessary Public Improvements as <br /> <br />described above (Public Improvements A - F) to service the proposed development. The <br /> <br />City agrees to proceed pursuant to Minnesota Statutes Chapter 429, the Petition and <br /> <br />Petition for Improvement Special Assessment Agreement/Waiver of Hearing and Appeal <br /> <br />signed by Developer dated January 29, 2007, and to specially assess $186,944.43 of the <br /> <br />cost of said Public Improvements including design and construction engineering, to the <br /> <br />subject property. The Developer hereby waives its right to appeal the amount of any <br /> <br />special assessments against its property within the described development. <br /> <br />8. DEVELOPER INSTALLED IMPROVEMENTS. The Developer shall install <br /> <br />and pay for the following improvements (the "Developer Improvements"): <br /> <br />A.
