MOTION by Councilmember Powers to close the public hearing. Motion seconded by
Councilmember Brenner. Motion carried unanimously.

Trio Inn
Mayor Wilharber opened the public hearing for questions or comments. The Council discussed an
alleged liquor law violation against the Trio Inn for selling alcohol on Thanksgiving Day.
Mr. Hellings noted the Council can discipline now or scheduled a continuation hearing after the
court proceedings.

Mr. Paul Montain owner of Trio Inn Bar (7082 Centerville Road) explained his position. Mr.
Montain agreed the off-sale violation was true. However, the action was not intentional and
there was no effort to deceive the City. Mayor Wilharber questioned Mr. Montain if the bar has a
policy or procedures for selling off-sale. Mr. Montain said the responsibility is with the managers
to direct bar tenders to either sell or not to sell and it was a management oversight.

MOTION by Councilmember Powers to close the public hearing. Motion seconded by
Councilmember Brenner. Motion carried unanimously.

APPEARANCES

CPLPD Recommendations for Waterworks Beach Club - Richard DeFoe
ChiefVanBurkleo summarized the meeting between Mr. DeFoe and himself. ChiefVanBurkleo
reported he had a productive meeting with Mr. DeFoe and all issues on the memorandum were
addressed to his satisfaction. Councilmember Powers stressed a safety concern with the
additional eighteen plus night, which makes three eighteen plus nights. ChiefVanBurkleo stated
the Police Department plans to address Mr. DeFoe's commitment to providing adequate security.
However, the Chief was unaware of an additional eighteen plus night.

Mayor Wilharber read aloud the Circle Pines - Lexington Police Department (CPLPD)
recommendations for Waterworks Beach Club. Mr. Bill Bisek (7098 Centerville Road) stressed
the State laws' spell out the Police Department's recommendations, such as, a bar cannot sell
alcohol to an obviously intoxicated person. Furthermore, placing contingencies on a liquor
license is unnecessary. Mr. Bisek added, this may eventually become a Council habit to put
stipulations on all liquor licenses. Mr. Hellings noted it is within the City's authority to place
stipulations on any liquor establishment.

Mayor Wilharber commented the recommendations were out of fairness to the liquor
establishment. As a friendly reminder these are the State laws and the City will be looking closely
at the stated areas. Mayor Wilharber asked Mr. DeFoe, ''How many eighteen plus nights are held
at Waterworks?" Mr. DeFoe responded the Staff completed training, therefore, he resumed the
eighteen plus nights which totals three nights.

Councilmember Powers stressed her concern about the eighteen plus nights.
