<br />Meeting Minutes - Cc <br />August 9, 1989 <br />Page Six <br /> <br />I <br /> <br />sidewalk. <br /> <br />Motion by Peterson, second by Pelton to direct the City staff and <br />Maier, stewart and Associates to complete the necessary paperwork <br />to apply for a flood damage reduction grant program as <br />administered by the Department of Natural Resources, motion <br />carried unanimously. <br /> <br />Dan Belland, 1994 North Robin Lane, and his father, Richard <br />Belland, appeared before the City Council regarding a variance <br />request to build a garage within the required setbacks at said <br />address. The Bellands advised that they fel t that there were <br />other houses within that development that were not in compliance <br />with City setbacks. Dan Belland advised that if this variance <br />were not granted he did not feel he could build a garage unless <br />he placed i t on the back of the property and put a cuI vert in <br />over the County ditch and a driveway out to the County road <br />(20th Avenue). <br /> <br />Motion by Neumann, second by Peterson to direct Gunnar Pettersen, <br />ci ty Building Inspector, to investigate the concern that other <br />homes within the Royal Meadows development may not be compliance <br />with City setback, motion carried unanimously. <br /> <br />Motion by Neumann, second by Peterson to deny the variance <br />request made by Dan Belland, 1994 North Robin Lane, to build a <br />garage 15 feet into the setback at 1994 North Robin Lane (ten <br />feet from the property line) for the following reasons: <br /> <br />-There do not seem to be special conditions and <br />circumstances existing which are peculiar to the land, <br />structure or building involved as the setting of Mr. <br />Bellands home and deck seem to be of his own doing, <br /> <br />-Granting the variance requested would seem to confer on the <br />applicant special privileges that is denied by the ordinance <br />to other lands, structures or buildings in this same <br />district and may set a precedence for other property owners <br />to request the same variance based upon their own planning <br />situation as opposed to fOllowing building requirements of <br />the Ordinance, <br />
