Meeting Minutes - Cc
August 9, 1989
Page Six

I

sidewalk.

Motion by Peterson, second by Pelton to direct the City staff and
Maier, stewart and Associates to complete the necessary paperwork
to apply for a flood damage reduction grant program as
administered by the Department of Natural Resources, motion
carried unanimously.

Dan Belland, 1994 North Robin Lane, and his father, Richard
Belland, appeared before the City Council regarding a variance
request to build a garage within the required setbacks at said
address. The Bellands advised that they fel t that there were
other houses within that development that were not in compliance
with City setbacks. Dan Belland advised that if this variance
were not granted he did not feel he could build a garage unless
he placed i t on the back of the property and put a cuI vert in
over the County ditch and a driveway out to the County road
(20th Avenue).

Motion by Neumann, second by Peterson to direct Gunnar Pettersen,
ci ty Building Inspector, to investigate the concern that other
homes within the Royal Meadows development may not be compliance
with City setback, motion carried unanimously.

Motion by Neumann, second by Peterson to deny the variance
request made by Dan Belland, 1994 North Robin Lane, to build a
garage 15 feet into the setback at 1994 North Robin Lane (ten
feet from the property line) for the following reasons:

-There do not seem to be special conditions and
circumstances existing which are peculiar to the land,
structure or building involved as the setting of Mr.
Bellands home and deck seem to be of his own doing,

-Granting the variance requested would seem to confer on the
applicant special privileges that is denied by the ordinance
to other lands, structures or buildings in this same
district and may set a precedence for other property owners
to request the same variance based upon their own planning
situation as opposed to fOllowing building requirements of
the Ordinance,
