<br />City Council Meeting Minutes <br />August 22, 1990 <br />Page 3 <br /> <br />Extension of Municipal Water <br />Mayor Haberman advised that he would have a problem recogn1z1ng <br />the Northdale bid and that he recommended that the City re-bid the <br />project. He appeared to feel that by not acknowledging the <br />addendum, Northdale may have been manipulating the bid. <br /> <br />Council member Burgstahler made several comments: <br />-He did not see how not aCknowledging the addendum could be <br />used as a ploy. <br />-The City appears to have two choices: to reject the bids and <br />reopen them to the public or award the bid to the low <br />bidder. <br />-Costs are increasing such as the cost of gas and he feels <br />that the City may be subject to a significant risk of an <br />increase in cost if they were to re-bid the project. <br />-He would like to award the project to the local contractor, <br />but his desire is not strong enough to incur an increase <br />in cost to the City and property owners. <br />-The city has obtained two Attorney opinions who both agree <br />that not acknowledging the addendum is an insignificant <br />issue. <br /> <br />Council member Neumann noted that the City can not afford an <br />increase in costs and would agree that the City's options would be <br />to either reject or reopen the bid to the public or award the bid <br />to the low bidder. <br /> <br />Council member Pelton noted that Barry Blomquist, attorney at law, <br />sites three cases that do verify that acknowledgement of the <br />addendum is insignificant. <br /> <br />The following audience members spoke regarding this issue. <br />Leon L'Allier, 1973 Main street <br />Jackie L'Allier, 1973 Main street <br />David Kaul, 1969 Main street <br />Dick Brown, 1976 Main street <br />Mary Jane Lang, 1559 Peltier Lake Drive <br /> <br />A copy of the City Attorney opinions by Bill Hawkins, attorney at <br />law, and Barry Blomquist, attorney at law, are on file with the <br />Clerk/Administrator. <br /> <br />Res idents expressed several concerns. The ci ty staff shall <br />investigate the amount of black dirt within the bid, the cost of <br />curb stops to the property and shall contact the city Forester for <br />advise on the ash tree in Leon L'Allier's front yard, 1973 Main <br />street. <br /> <br />The residents at 1969 Main street, 1973 Main street, 1976 Main <br />
