<br />Meeting Minutes - CC <br />August 8, 1990 <br />Page 8 <br /> <br />-He did not want to dwell on past decisions of the City <br />Councils. <br />-He felt it unfortunate that much money has gone out the door <br />for litigation costs. <br />-He advised that negotiation and mediation since the end of <br />the previous City Council has not been an option. <br />-He favored some type of solution that would not penalize any <br />persons involved. <br />-He is not prepared to make a recommendation at this City <br />Council meeting. He would like to speak to the City <br />Attorney in more detail. <br />-The City of Centerville is approximately one quarter of a <br />million dollars short as a result of the judgement which <br />now makes it difficult for the City of Centerville to do <br />the projects it would like to. <br /> <br />Council member Neumann: <br />-The City Council has voted not to appeal the litigation due <br />to possible increase in cost and the proposed odds of a <br />successful appeal. <br />-He would like to see more options for a fair adjustment to <br />the persons who did not petition for an appeal. <br />-He is concerned that in using option #3 the City would open <br />itself up to litigation. <br /> <br />The following residents were present and asked questions and <br />expressed concerns regarding the 1987 street Litigation <br />Reassessments and Proposed Reassessments. <br />Dan Kupfer, 1761 Center street <br />steve HUlback, 1736 Center street <br />Jeff Daas, 1737 Center street <br />Beverly Hughes, 1793 Center street <br />Mike Habas, 7167 Shad Avenue <br />Wayne Hanson, 7200 Mill Road <br />Art Mohler, 1756 Peltier Lake Drive <br />Mary Jane Lang, 1559 Peltier Lake Drive <br />Rebecca Campbell, 1745 Center street <br />Archie Gay, 7154 Shad Avenue <br /> <br />Motion by Pelton, second by Neumann to direct City staff to meet <br />with Council member Burgstahler to investigate other options for <br />a possible reassessment to the properties not involved in the 1987 <br />Street Reconstruction Litigation; <br />-all City Council members are requested to contribute their <br />thoughts for possible solutions to City staff; <br />-City staff shall pursue the city Council suggestions to <br />attempt to obtain the best option possible for City <br />Council consideration; <br />motion carried unanimously. <br />
