City Council Meeting Minutes of November 8, 1995

Councilmember Buckbee stated that they have a good track record, all those placed by
Mr. Brimeyer have been in their position for at least 5 years.

Mr. Brimeyer explained the interview process and also talked about a "Bonus" option or a
"Contract" option.

Mr. Brimeyer was asked to prepare a proposal for the council to act on.

OLD BUSINESS

ACORN CREEK SECOND ADDITION
ASSESSMENTS
The lots on Old Mill Road were never assessed but the improvements were paid through
the assessments in Acorn Creek One.

MOTION by Buckbee, second by Helmbrecht to approve the Assessment Schedule with
the constant annual payment method of$8,743.24 per lot. Lots to include 3 through 9 of
block 2 and lots 4 through 9 of block 3. Motion carried unanimously.

GRADING PLAN
Paul Palzer pointed out to Councilmember Helmbrecht that a survey is required by the
developer before the certificate of occupancy is issued. And also recommended that the
ordinance be changed to reflect the survey be obtained at the time the foundation is done
versus when the house is completed. Another item Paul Palzer would like in the ordinance
is what the tolerance level is and how much it can differ.

Dave Nyberg stated that pond lots are an exception and may require a variance from an
ordinance.

The consensus of the council is to make sure the elevation is checked to lessen the amount
of drainage issues. If the laser lever is purchased Paul Palzer would be able to conduct the
"shoot" ofthe elevation without going through the engineer.

MOTION by Helmbrecht to request the building inspector to ask for a certificate of
survey when the foundation is complete. Helmbrecht then rescinded the motion.

Councilmember Buckbee likes the as built grading plan as mentioned in Dave Nyberg's
letter dated October 31, 1995 . Would also like it in the Developer's Agreement as well as
having the ordinance amended.

MOTION by Helmbrecht, second by Buckbee, to forward to Planning and Zoning to
consider when the certificate of survey should be required, and something to the effect
that they would have to wait on construction until the survey is approved and to also

CC11-8MM.WPS

3
