A copy of this letter is on file with the <br />Clerk/Administrator. <br /> <br />Motion by Dario, second by wilharber that per the recommendation <br />of Dave Nyberg, city Engineer, to approve the Final Pay Estimate <br />to Bituminous consulting and contracting in the amount of <br />$15,214.98 for the 1994 street Repairs to include the Change <br />Orders added to the project as part of the ADA Grant Projects at <br />Central and Water Tower Park, motion carried unanimously. <br /> <br />PETITIONS AND COMPLAINTS: <br /> <br />Building Permit Fees - 7288 Mill Road. <br />George Haberman, 7288 Mill Road, was present. Mr. Haberman noted <br />his concern is regarding the minimum building permit fees. Mr. <br />Haberman noted according the building code and City ordinance if <br />you pound one nail into your siding you are required to take out <br />a $15.00 building permit. <br /> <br />The City Council reviewed a letter dated October 26, 1994 from <br />Paul Palzer, Public Works Director/Building Inspector, regarding <br />the current building permit fees. A copy of this letter is on <br />file with the Clerk/Administrator. <br /> <br />Council member Helmbrecht expressed concern regarding changing <br />the existing building permit requirements. The storage building is currently located at <br />Kelly'S Korner. The owner of Kelly's Korner has requested that <br />the centerville Lions relocated the building to allow for <br />additional parking space for his business. <br /> <br />It was noted that City staff has contacted Peter Tritz at the <br />League of Minnesota cities. Mr. Tritz suggested the city and the <br />centerville Lions prepare a written agreement to include the <br />following: <br />who will be responsible <br />etc., if the storage <br />property: <br />to include provisions that centerville Lions will <br />defend and indemnify any person injured, etc., relating <br />the relocation of the shed: <br />that the centerville Lions should name the city as an <br />additional insured on their liability pOlicy: <br />when an agreement has been written it will be forwarded <br />to Ellen Longfellow, an Attorney for the League of <br />Minnesota cities to review, advise or alter. <br /> <br />for maintaining the building, <br />shed is relocated to city <br /> <br />Motion by Buckbee, second by wilharber to authorize city <br />work with the Centerville Lions Club on an agreement to <br />the Lion's storage shed onto city property: <br />permit fees that may be required <br />relocated the storage shed are waived, <br />motion carried unanimously. <br /> <br />staff to <br />relocate <br /> <br />to <br /> <br />temporarily <br /> <br />Consulting Engineering Service - Direction. <br />It was noted that several consulting engineering firms have <br />contacted City staff regarding providing the city with their <br />services for 1995. <br /> <br />Council member Helmbrecht noted that she has spoken with council <br />member Brenner, and neither one of them have spoken with outside <br />consulting engineering firms requesting proposals. <br /> <br />Council member Brenner questioned when the appointments are made <br />in January, are they considered to be a one year contracts? <br /> <br />Council member Wilharber expressed that it is very important that <br />anything of this magnitude be discussed with the entire Council. <br />
