It was noted that not all inquires leave a business' card.' <br /> <br />Mayor Buckbee expressed concern with what individual Council <br />members may be telling people, rather then having prospective <br />businesses go through the proper channels. He expressed that he <br />feels it is a lack of general ethical courtesy for individual <br />Council members to solicit businesses without informing the <br />entire City Council. <br /> <br />Motion by Buckbee, second by Dario to authorize Council member <br />Brenn7r to follow up on perspective businesses that inquire at <br />the C1ty Hall, motion carried unanimously. <br /> <br />Viola~ion of O:dinance #8 - permission to Proceed. <br />T~e C1ty Co~nc7l reviewed a letter from Paul Palzer, Public Works <br />D1re~tor/Bu1ld1ng Inspector, regarding permission to proceed with <br />sodd1ng.of the rear yard at 1968 72 1/2 Street. A copy of this <br />letter 1S attached to and made a part of these minutes. <br /> <br />Motion by. Buckbee, second by Wilharber to authorize City staff to <br />proceed w1th the necessary steps to sod or seed the rear portion <br />of Lot 11, Block 2 - Center Hills Second Addition. <br />the Public Works Director/Building' Inspector is <br />requested to solicit bids from the appropriate <br />contractors to perform the work: <br />t~ request the City ~ttorney's written opinion that the <br />C1ty has the author1ty to take the appropriate action <br />regarding the violation; <br />the Circle Pines/Lexington Police Department shall be <br />available to ensure access to the property: <br /> <br />CITY COUNCIL MEETING MINUTES <br />OCTOBER 26, 1994 <br />PAGE THREE <br /> <br />been able to work on the Brian Drive crossing due to the weather. <br />The Contractor has expressed concern regarding the high water <br />level. <br /> <br />Mr. Nyberg noted the Brian Drive residents are to be commended <br />for their patience and cooperation during the construction. <br /> <br />Mr. Nyberg updated the City Council on the Rice Creek Watershed <br />Bed and Stream Bank Stabilization Program. It is not contingent <br />upon the City funding one third of the cost. Kate Drewry, Rice <br />Creek Watershed District Administrator, has noted that if the <br />residents agree to pay two thirds of the cost, the Rice Creek <br />Watershed District will contribute one third. <br /> <br />Council member Helmbrecht questioned when the sidewalk along Main <br />Street will be completed. <br /> <br />Mr. Nyberg noted weather permitting, the sidewalk should be <br />finished this fall, hopefully as soon as next week. <br /> <br />Council member Helmbrecht updated the City Council regarding the <br />additional funding from Anoka County for the Main Street vertical <br />curve. It appears from the discussions, the increase in cost for <br />the vertical curve, if included in the scope of the County's <br />overlay project, would have been approximately $3,000.00 due to <br />the size of their project. <br /> <br />Mr. Nyberg noted Jon Olson, Anoka County Highway Director, has <br />indicated at this time the County has approximately $4,500.00 <br />available for the funding of the additional costs for the <br />vertical curve. Mr. Nyberg suggested the City wait until the <br />final costs are available and continue negotiations at that time. <br /> <br />Mayor Buckbee questioned who will be held responsible if the <br />bituminous overlay on the County Road breaks up due to the <br />weather conditions during application. <br /> <br />Mr. Nyberg explained the City has a one year guaranty for the <br />workmanship and labor from the Contractor. If the break up in <br />the bituminous is not caused from normal wear and tear, the <br />Contractor will be responsible. <br /> <br />Mr. Nyberg expressed he has worked with City staff and the <br />Contractor to develop an agreement for replacement of the trees <br />on the Dornseif property at 1783 Peltier Lake Drive. <br /> <br />Council member Brenner noted residents are still concerned <br />regarding the fencing at Peltier Lake Drive culvert. <br /> <br />Mr. Nyberg noted he has not received costs from the Contractor. <br />
